2314.05 6' 70 <br />gifts I have initiated. To follow and implement any estate <br />plan that I have formed. Gifts may be made to my said <br />attorney if my attorney is a member of my family and would <br />otherwise be deprived of an equal share. <br />W. To disclaim. To renounce and disclaim in whole or in part, <br />fractional shares or specific assets in the manner provided <br />by law, any property or interest in property of any kind <br />whatsoever, passing to me by intestate succession, as <br />devisee, as successor of a renounced interest, as donee, as <br />beneficiary under a testamentary or nontestamentary <br />instrument, as donee of a power of appointment, as grantee, <br />as surviving joint owner or surviving joint tenant, as <br />beneficiary of an insurance contract, or as the person <br />designated to take pursuant to a power of appointment <br />exercised by a testamentary or nontestamentary instrument, or <br />as recipient of any benefit otherwise under a testamentary or <br />nontestamentary instrument, and to execute and deliver and <br />file in the appropriate Court, or with the proper authority <br />any such renunciation or disclaimer. <br />X. To appoint guardian and conservator. To nominate a guardian <br />for my person and a conservator for my estate if such <br />protected proceedings are commenced. <br />Y. Access to safe deposit box. <br />My attorney shall have full and free access to my safe <br />deposit box. <br />Z. Power of attorney becomes effective upon disability or <br />incapacity of principal; continues in effect after <br />principal's death until notice. <br />Pursuant to the provisions of the Nebraska Probate Code, I <br />declare that this power of attorney shall become effective <br />upon my disability or incapacity, but not until then, and <br />that the authority granted herein shall continue during any <br />period while I am disabled or incapacitated. Further, <br />pursuant to said sections, all such authority shall continue <br />after my death, until notice of such death shall have been <br />received by my attorney so that said attorney has actual <br />knowledge of the fact that I have died. Any action taken in <br />good faith by said attorney during any period while it is <br />uncertain whether I am alive, before he or she receives <br />actual knowledge of my death, or, in any event, taken during <br />the period while I am disabled or incapacitated, shall be as <br />valid as if I were alive, competent, and not disabled. <br />
