Squier, being first duly sworn upon oath, deposes and state as follows: <br />AFFIDAVIT TO TERMINATE FIRST RIGHT OF REFUSAL <br />C; <br />N <br />CT) <br />— TJ <br />1. That he has personal knowledge of the facts contained within this affidavit and makes the <br />following representations with full knowledge of the facts and circumstances contained herein. <br />2. That on May 20, 2009 a lease was entered into between Gale D. Squier and Kay L. Squier as <br />Landlord and Leigh Lillibridge Insurance Agency, Inc., as Tenant (the "Lease ") regarding <br />property located at 3022 W. Old Potash Highway, Grand Island, Nebraska and legally described <br />as: <br />The West 100 feet of Lots 4, 5 and 6, Warren Subdivision, Grand Island, Hall <br />County, Nebraska, Nebraska ( "the Property "). <br />:r <br />5. That on August 1, 2010 the Tenant assigned the Lease to State Farm Insurance, a copy of the <br />Assignment being attached hereto as Exhibit "A" and incorporated herein by this reference. <br />CD <br />3. That contained within paragraph 20 of the Lease was a provision obligating the Landlord to first <br />offer to sell the Property to the Tenant in the event the Landlord elected to sell the Property <br />during the term of the Lease. <br />4. That on May 20, 2009 a Notice of First Right of Refusal was filed with the Register of Deeds of <br />Hall County, Nebraska at Instrument No. 200903984 providing notice of the Tenants right of first <br />refusal as setforth in Paragraph 20 of the Lease. <br />6. That on October 19, 2001 State Farm Insurance, as Assignee of the Lease provided written notice <br />to the Landlord that the Lease would terminate effective December 15, 2011. That Landlord is in <br />possession of the written notice of termination of the lease <br />7. That the Lease terminated on December 15, 2011 and was not renewed. That at no time during <br />the term of the Lease did the Landlord decide to sell the Property and did not receive any offers <br />of sale of the Property which would have required Landlord to give the Tenant or State Farm <br />Insurance, as Assignee of the Lease, written or verbal notice of Landlords intent to sell the <br />Property. <br />The fore oing Affidavit w acknowledged before me this Oa, day of August, 2011 by Gale D.
