• Participation in the Fitness Program; <br />• Use of the Exercise Equipment in the Fitness Areas <br />• Use of the Swim Spa when accompanied or in the presence of another adult; <br />• Participation in the Activity Program at the Lodge; <br />• Access to the Transportation Services; <br />• Request for a Maintenance Person; <br />• Priority access, if the need arises, to Independent Apartment or Assisted Living <br />Apartment Rental and services. <br />(e) This Associate Membership Fee is not transferrable or cancellable. It remains active <br />during the entire time the owner /owner's spouse or partner are residents of the <br />Village or of The Riverside Lodge Retirement Community and the unit is sold to <br />another qualified party, <br />Section 3. Rules of Conduct. <br />Rules and regulation concerning the use of the units, the garages and the common areas <br />and facilities and improvements on Outlots A, B, and C, including the limited common areas and <br />facilities, and any subjects set forth in the Master Deed and Declaration, may be promulgated <br />and amended by the Executive Board. Copies of such rules and regulations shall be furnished by <br />the Executive Board to each unit owner prior to the time when the same shall become effective. <br />Section 4. Right of Access. <br />A unit owner shall grant a right of access to his unit or garage to the manager and/or <br />managing agent and /or any other person authorized by the Executive Board, the manager or the <br />managing agent, for the purpose of making inspections or for the purpose of correcting any <br />condition originating in his unit or garage and threatening another unit or garage or a common <br />area or facility, or for the purpose of performing installations, alterations or repairs to the <br />mechanical or electrical services or other facilities in his unit or garage or elsewhere in the <br />buildings, provided that requests for entry are made in advance and that any such entry is at a <br />time reasonably convenient to the unit or garage owner. In case of emergency, such right of entry <br />shall be immediate, whether the unit or garage owner is present at the time or not. <br />Section 5. Abatement and Enjoining of Violations. <br />12 <br />201405206 <br />The violation of any rule or regulation adopted by the Executive Board or the breach of <br />any of these By -Laws contained herein, or the breach of any provisions of the Master Deed and <br />Declaration, shall give the Executive Board the right, in addition to any other rights set forth in <br />these By -Laws: <br />(a) To enter into the unit or garage in which, or as to which, such violation or breach <br />exists and to summarily abate and remove, at the expense of the defaulting unit or <br />garage owner, any structure, thing or condition that may exist therein contrary to the <br />intent and meaning of the provisions hereof, and the Executive Board shall not <br />thereby be deemed guilty in any manner of trespass. <br />(b) To enjoin, abate or remedy by appropriate legal proceedings, either at law or in <br />equity, the continuance of any such breach. <br />(c) To deny partially or wholly access to, benefit from, or use of all or any facilities, <br />functions, or services, or suspend, partly or wholly of all or any rights or privileges of <br />membership or any other disciplinary action directed by the Executive Board. <br />ARTICLE IX.
