<br /> limitation any agreemen� concerning any indebfiedness ❑r ❑ther obliga�ion of Barrower ar Trustar t❑ Lender,
<br /> whether existing now�r la�er.
<br /> E�ents Affecting Guaran�vr. Any of the preceding e�ents accurs wi�h r�sp�ct �❑ any Guarantor vfi any af the
<br /> lndebtedness vr any Guarantor dies or becomes incompeten�, or re�okes or disputes the �alidity o�f, ❑r �iability

<br /> belie�es�he prospect of payment❑r per�armance o�the [ndebfiedness is impaired.
<br /> lnsecurity. Lender in good�aith 1�elie�es itsel�insecure.
<br /> Righ�t to Cure. lf any defaul�, ❑ther than a defaul�in payment is curable and if Trustor has nvt been gi�en a notice
<br /> of a breach of the same proWision o�this Deed af Trus�wifihin the preceding twel�e {�2} mon�hs, �t may be cured if
<br /> Trustor, afker Lender sends written natice t� Borrower demanding cure o� such default: ��} cures the defaul�

<br /> RIGHTS AND REMEDIES �N DEFAULT. ff an E�ent❑f De�ault occurs under this Deed vf Trust, a� any time �hereafter,
<br /> Trustee ar Lender may exercise any one or mvre of�he following rights and remedies:
<br /> Accelerativn Upon Defaui�; Additivnal Remedies. If any EWen�of Defaulfi❑ccurs as per the �erms ❑f the No�e
<br /> secured h�reby, Lend�r may declare all Indebtedness secured by this Deed of Trust to be due and payab�e and
<br /> the same sha[I�hereupvn become due and payable w�thou�any presentmen�k, demand, protest vr no�ice❑f any
<br /> kind. Ther�after, Lender may:
<br /> �a} Either in person or hy agent, wi�h or wi�hou�k bringing any activn ❑r praceeding, or by a recei�er
<br /> appoin�ed �y a cour� and wifhvut regard to �he adequacy of its security, enter upon and take possession
<br /> ❑f�he Property, vr any part thereo�, in its own name or in the name ❑f Trust��, and d❑ any ac�s which i�
<br /> deems necessary❑r desirable to preser�e the walue, marke�abili�y or rentability of�he Praper�y, ar part of
<br /> the Property ❑r interest in the Property; increase �he income from the Property or protect�he se�urity of
<br /> fihe Prvperty; and, wi�h ❑r without taking possession of the Property, sue far ar o�herwise collecfi the
<br /> ren�s, issues and profits o�the Proper�y, inc�uding thase past due and unpaid, and apply the same, less
<br /> costs and expenses ❑f operation and cot[ection attorneys' fees,to any indelatedness secured by this �]eed
<br /> of Trus�, all in such vrder as Lender may determine. The entering upan and taking possessian vf the
<br /> Property, the collection of such rents, issues and profits, and the appli�ativn thereof shall na� cure vr
<br /> wai�e any default or notice �f defaul� under fhis �eed ❑f Trust or in�alidate any act done in response to
<br /> such defaul�or pursuant t❑such nv�i�e a�default; and, natwithstandin�the con�inuance in passession a�
<br /> the Property o�-the �allectivn, re�eip� and application of rents, issues or profits, Trustee or Lender shaii
<br /> be enti�led to exercise e�ery right pro�ided for in the Nvte vr�he Rela��d ❑ocuments or by law upon the
<br /> ��curr�nce ❑f any e�ent❑�F defaulfi, in�luding the rEght�❑ exercise the power❑f sale;
<br /> �b} Commence an ac�ion�o forec�ose�his aeed ❑�F Trust as a mortgage, appoint a recei�er ar specifica�fy
<br /> enforce any❑f the co�enants hereof; and
<br /> ��} L�eliver t❑Trus�ee a written declaration of defaul�and demand �or sale and a written no�ice of de�ault
<br /> and election to cause Trustvr's int�r�st in the Property to ia�soid, whi�h no�ice Trustee shall cause to be
<br /> duly fil�d fvr recard in the apprapriafie affices of the Coun�y in which�he Proper�y is located; and
<br /> �d} With respe�t to all vr any par�of�he Personal Property, Lender shall ha�e all �he rights and remedies
<br /> ❑�a secured par�y under the Nebraska Llniform Commercial Code.
<br /> Foreclosure by Power of Sale. If Lender elects to foreclase hy exer�ise af�he Power of Sale herein �on�ained,
<br /> Lender shall notify Trustee and shall depasit with Trustee this Deed ❑f Trus� and �he Nvte and such receipts
<br /> and e�idence ❑f expendifiures made and se�ured �y�his aeed ❑f Trus�as Trus�ee may require.
