<br />KNOW ALL MEN BY THESE PRESENTS, that AGRICULTURAL SERVICES, INC.,
<br />a Nebraska corporation, GRANTOR, for valuable consideration, receipt of which is hereby
<br />acknowledged, does hereby give, grant, and convey unto the VILLAGE OF ALDA,
<br />NEBRASKA, a municipal corporation, GRANTEE, a perpetual easement and right -of -way over,
<br />across, under, through, and upon the following- described real estate, to -wit:
<br />A PARCEL OF LAND LOCATED IN LOT 12, COUNTY SUBDIVISION OF
<br />THE NORTHWEST QUARTER AND THE NORTHEAST QUARTER OF
<br />SECTION 5, TOWNSHIP 10 NORTH, RANGE 10 WEST OF THE SIXTH
<br />P.M., VILLAGE OF ALDA, HALL COUNTY, NEBRASKA, BEING
<br />DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER
<br />OF LOT 12, COUNTY SUBDIVISION; THENCE S87 °11'36 "W (ASSUMED
<br />BEARING) ON THE SOUTH LINE OF SAID LOT 12, A DISTANCE OF 30.01
<br />FEET; THENCE N01 ° 14'02 "W, PARALLEL WITH AND 30.00 FEET
<br />DISTANT FROM THE EAST LINE OF SAID LOT 12, A DISTANCE OF
<br />317.25 FEET; THENCE N87 °58'45 "E, A DISTANCE OF 30.00 FEET TO SAID
<br />EAST LINE; THENCE S01 °14'02 "E ON SAID EAST LINE, A DISTANCE OF
<br />316.84 FEET TO THE POINT OF BEGINNING, CONTAINING 0.21 ACRES,
<br />MORE OR LESS.
<br />Said easement includes but is not limited to the right to install, construct, maintain,
<br />replace, and operate a sewer line or lines by the GRANTEE within the described easement area
<br />in connection with its public sewage disposal system. It is further provided that said easement
<br />shall be deemed to provide GRANTEE with the right of unrestricted access to its sewer line or
<br />lines by ingress and egress over, across, through, and under the lands described herein, together
<br />with all rights of ingress and egress necessary for the full and complete use, occupation, and
<br />enjoyment of the easement hereby granted, including the right to excavate and refill ditches and
<br />trenches for the location of said sewer line or lines and appurtenant structures related thereto.
<br />To have and to hold the same unto the said GRANTEE and its successors and assigns as
<br />appurtenant to the land and every part thereof; and GRANTOR hereby dedicates its interests in
<br />said real estate to the use of the GRANTEE. This easement is perpetual and shall run with the
<br />land.
<br />In addition to the perpetual easement granted hereinabove, GRANTOR, for the purpose
<br />of permitting initial construction, stockpiling of materials, parking of equipment, and
<br />encroachment necessary to initially install pipes and related equipment for such sewer line,
<br />grants and conveys unto GRANTEE a temporary construction easement ( "Temporary
<br />Easement ") over, through, and across that real estate described as:
<br />A PARCEL OF LAND LOCATED IN LOT 12, COUNTY SUBDIVISION OF
<br />THE NORTHWEST QUARTER AND THE NORTHEAST QUARTER OF
<br />SECTION 5, TOWNSHIP 10 NORTH, RANGE 10 WEST OF THE SIXTH
<br />P.M., VILLAGE OF ALDA, HALL COUNTY, NEBRASKA, BEING
<br />DESCRIBED AS FOLLOWS: REFERRING TO THE SOUTHEAST CORNER
<br />OF LOT 12, COUNTY SUBDIVISION; THENCE S87 °11'36 "W (ASSUMED
