<br /> Now on this 29th day of Maq, H.D. 1923, this cause came on to be
<br /> heard upon the petition of Joachim W, Stoltenberg, one of the Executors
<br /> of the Last Will and Testament end Estat� of Joachim Stoltenberg,
<br />! deceased, to reopen said estate and file an amended inventory and an
<br />� amended decree, said amended inventory to include certain real estats
<br /> ow.ned by the said deceased at the time of his death which, t�ru mistake,
<br /> was not included or described in the Last will and Testament of the s�id
<br /> Joachim Stoltenberg, deceased, and therePore not included in the final
<br /> decree entered and redorded in the County Court of Howard Count�,Nebraska,
<br /> in the above entitled estate, on the 20th day of Januar�r, 1900, and said
<br /> petitioner prays that said administration be completed to inclue said
<br /> real estate hereinafter described and an inventory be filed and a decree
<br /> entered. I
<br /> Said cause ceming further to be heard upon said petition and upon
<br /> the voluntary appearance and conse�t of Henry W. �irkholz, the remaining
<br /> F.�cecutor oP the Last Will and Testament of Joachim Stoltenberg, deceased,
<br /> and Agnes Birkholz, hi§ �wife, the rem�.ining legatee under said Last will
<br /> and Testament and the evidence in sup�ort thereof and was submitted to
<br /> the court and the eourt being fully advised in the premises, finds that
<br /> the said Jsachim Stoltenberg died seized of the following described
<br /> premises, to-wit:
<br /> Lots Nine (9) and Ten ( 10) in Section twenty-seven (27) , and Lots
<br /> One (1) , Two (2) , Three (3) and Four (!}) and the Southeast quarter
<br /> of the Northeast Quarter (S� N�) and the South.west quarter of
<br /> the Southeast Q�narter ( SW1 SE4) and the Best Ha1f of t�.e Southeast
<br /> quarter (W2 SE4� and the 1Jorth half oP the Southwest quarter (N2SW4)
<br /> of Section Ehirty-£ive (35) , Township Thirteen ( 13) , Range Twelve
<br /> (12) West of the 6th P.M. Howard County,PTebraska.
<br /> Also the Westerly Seventy-1'our and one-fourth feet of Lot Nine (9)
<br /> of the County Sub-division of the Southhal� of the Southeast quarter
<br /> ( S2 SE1) of S etion six�een ( 16) , Township eleven ( 11) Range Nine (9) ,
<br /> kTest o�' the 6�h P. M. , in Hall County, Nebr�ska,
<br /> and that thru mistake, error or omission the last �bove described property
<br /> located in Hall Count,y, Nebraska, was not included in said Last Will and
<br /> Testament and none of the above described property was included or shown
<br /> in the inventory in said estate and that no complete inventory thereof
<br /> was ever filed in the County court of Howard County, Nebraska, and that
<br /> the pra�-er of the petitioner should be allowed and said estate re-opened
<br /> for the purpose o£ filing said amended inventory and entering an amended
<br /> and supplemental decree therein as by law provided.
<br /> IT IS TH�'REFORE, ORDE RED, ADJUDGED AND DECREED BY THE COURT, that
<br /> the sa id Joachim 5tolten�erg be and hereb� is allowed to file an amended
<br /> inventory in said Estate.
<br /> It is further orderd and considered by the court that the said
<br /> Joachim Stoltenberg died seized of the above described property and that
<br /> in the proceedings to probate his estate and under the terms and conditions
<br /> of said Last �ill said real estate passed and descended to the said Joachim �
<br /> W. Stoltengerg and Agnes Biiekholz, son and dau�hter of said deceased, and j
<br /> Fred Stoltenberg, son of sleceased, who are all the heirs at law of said
<br /> deceased. �
<br /> And the Court further Pinds that under the terms of said Will, the
<br /> last. e�bove described property, to-wit: The West Seventy-four and one- '
<br /> urth feet of' Lot Nine (�) , of the County Sub-Division of the South j
<br /> hal of theSoutheast Quarter (S� S�) of Section Sixteen { 16) , Township
<br /> Eleven (11) , Range N;ne (9) , West of the 6th P.M. in Ha1T County,Nebraska, �
<br /> �.id pass and descend at the dat� of death of the said Joachim Stoltenberg �
<br /> to the said Joachim W. Stoltenberg and Agnes Birkholz and Fred Stoltenber-g, �
<br /> in equal shares to each.
