<br /> ORDER ADMITTING WILL TO PROBATE
<br /> THIS third day of March, A.D. 1952, a regular judicial day of this
<br /> court, this cause comes on to be heard upon the petition of 1�nna E.
<br /> Dehner on file herein, praying for admission to probate in this court
<br /> of an instrument in writing, also on file herein, purporting to be the
<br /> last VJill of Bena A. Dehner� who, it is alleged in said petition, departed
<br /> this life on the 1 th day of Februarv, A.D., 1952_,7�avir� s�vivirag no.:husbandm�
<br /> certain legatees and devisees under the terms of said purported Will,
<br /> �s said hPirs, lgatees, and devisees are in said petition stated.
<br /> And now from said petition, said instrument, the proceedings had
<br /> herein and competent evidence, the court finds :
<br /> That the said petition is duly verified, is in due form of 1aw and
<br /> that the i'acts herein stated as same are above set forth are tn�.
<br /> `That all the said heirs at law and legatees of said deceased, as
<br /> same are in said petition named and stated, are of legal age and under
<br /> no legal disabilities and have either signed said petition or have
<br /> entered their appearance in writing herein, waiving all not ice to them of
<br /> this proceeding. .
<br /> =�That to each of the heirs at law, legatees and devisees of s aid de--
<br /> ceased, whose names and post office addresses are in said petition state:�,
<br /> (except to such as have signed said petiti.on, or, being under no legal
<br /> dzsabilities, have entered appearances in writing herein, waiving all
<br /> notice of this proceeding) .
<br /> That said instrumeht offered for probate herein consists of an
<br /> original document o£ date the 15th, day of July, ti.D. 19�.
<br /> Wherefore the court further finds that it has full and complete
<br /> jurisdiction to hear and determine this cause. "
<br /> =`And now at this hearing comes Vlilliam �I'. Ber�er, whose name is
<br /> subscribed ta said purported Will of date Julv 15th, 1939, as an attest-
<br /> ing witness thereto, and testfies bef�re the cour t that, being present
<br /> on saidc�te, he saw the said Bena �. Dehner, sign said instrument as the
<br /> testator thereof, that thereupon in the presence of said testator he,
<br /> �he said witness, signed and attested said instrument as a witness
<br /> thereto a:�d that he, the said witness, believed that at the time said
<br /> tes*ator si�ned said instrument, the said testator was of sound mind anQ
<br /> m2mary.
<br /> And now at this hearing comes Geor�e W. Ohmes, whose name is
<br /> subscribed to said purported Will oi date July 15, 1939, as an attesting
<br /> witness thereot, and testifies before the Court that, being present
<br /> on said date, he saw the said Bena ti. Dehner, sign said instrument as
<br /> the testator thereof, that thereupon in the presence of said testator
<br /> he, the said witness, signed and attested said instrument as a witness
<br /> t�hereto and that he, the said witness, believed that at the time said
<br /> testator signed said instrument, the said testator was of sound mind ar�l
<br /> memory.
<br /> t�rid now from the aforesaid and other competent evidence offered and
<br /> received herein, the court finds that the said instrument offered for
<br /> grobate herein was duly signed, executed and attested according to
<br /> law, that the testator hereof was of legal age and of sound mind and
<br /> memory at the time of signing same, that said instrumet has been
<br /> sufficiently proved to admit i� to probate and that there is no proof
<br /> before the court of fraud, forgery, compulsion or other improver conduct
<br /> which in the opinion of the court is deemed sufficient to inalidate or
<br /> destroy the same.
<br /> It is therefore ordered by the court that the said instrument be and
<br /> the same is hereby declared to be the last will �f the said Bena A. Dehner,
<br /> deceased, and that the sam'e be admitted to probate and record in this
<br /> caurt as the last Wi11 'of said deceased.
