i <br /> That �he fair market value of sazd real estate at the date of death <br /> was $11,000.00; that at the date of deeth there w�s e� mortgage <br /> against said real estate dated March 7, 1963, in .the amount of <br /> $$800.00, with the amount remaining due at the date of death in the <br /> sum of $8,644.90. � <br /> That shortly prior to her death, decedent had a checking <br /> account in the Ashton State Bank, Ashton, Nebraska, with a balance <br /> of $1,200.00, which she transferred and assigned to Richard A. <br /> Maciejewski who was the owner of said bank account at the date of <br /> death of the decedent. <br /> That at the date of her death, decedent was also the owner <br /> of certain household goods of the clear market value �of $300.00. <br /> That the decedent owned no other property at the time <br /> of her death; that the decedent made no transfers by deed, grant, <br /> ° sale or gift, in trust or otherwise, made in contemplation of her <br /> death, intended to take effect in possession or enjoyment after <br /> her death other than stated herein; nor did any person or persons <br /> become beneficially entitled in possession or expectation to any <br /> property or income therefrom, except as heretofore set out. <br /> That more than two years have elapsed since the death of • <br /> said deceased and no application has been made for the appointment <br /> of an administrator of her estate and no admini5trator of her <br /> estate has been appointed in Nebraska; that all claims and obliga- <br /> tions existing against the estate of the said Martha Maciejewski <br /> have been fully paid. <br /> That Martha Maciejewski left as her sole and only heirs- <br /> at-law the_ petitioner, Richard A.
