<br /> ARTICLE II
<br /> I hereby give, devise and bequeath to my son, Rudolph E.
<br /> Eckhardt, of Hastings, Nebraska, all of my property and estate, real,
<br /> personal or mixed, of whatever kind and wherever situated to be his
<br /> absolutely in fee simple, if he survi.ves me.
<br />' ARTICLE III
<br /> If my said son does not survive me, I give, devise and be-
<br /> queath all of my said property and estate to my granddaughters, Betty I
<br /> Ann Pe��k, presently of Storm Lake, Iowa, and Donna Jean Johnson, of
<br />, Glenvil, Nebraska, share a�� share alike, the issue of such of my
<br /> said granddaughters as may be deceased at my death, to take the share
<br />;
<br /> of hi.s, her or their deceased parent, by right o� representation.
<br /> ARTICLE N
<br />� I nominate and appoint my granddaughters, Betty Ann Peck and
<br />� Donrza Jean Johnson, as joint executrixes of my Wiil with the following .
<br /> powers and any others that may be granted by law, to be exercised in
<br /> t.heir discretion without any Court order:
<br />� (a) To retain any property of my estate;
<br />,; (b) To sell any real or personal property of my estate, for
<br /> cash or on credit, at public or private sales, for any purpose; to
<br /> exchanqe any such property for other property; to grant options to
<br /> purchase or acquire any such property; and to determine the prices
<br /> and terms of sales, exchanges and options; • •
<br /> (c) T� employ attorneys, auditors, depositaries, proxies
<br /> and agents, with or without discretionary powers; and to keep any
<br /> �roperty in the name of an exeGutrix or a nominee, .witl7 or without
<br /> disclosure of any fiduciary relationship, or in bearer form;
<br /> (d) To collect, pay, contest; compromise or abandon claims
<br /> of or against my estate, wherever situated; and to execute contracts,
<br /> conveyances and. other instruments, includin9 instruments coritaii►ing
<br /> covenants and warranties bindinq upan and .creating a charge against
<br /> my estate, and containing provisions excluding personal liability;
<br /> _ (e) To borrow money for any purpose connected with the
<br /> protec.tion, preservation or improvement of my estate, whenever in
<br /> their judgment advisable, and as security to mortgage or pledge any
<br /> property forming part of my es'tate on such terms and conditions as
<br /> they may deem advisable;
<br /> {f) To operate and manage farm properties in my estate,
<br /> to maintain and improve such properties, i:o enter into leases, partner-
<br /> ship agreements or management agreements, including such agreements
<br /> w,ith members of my family upon such conditions and f�r such terms as
<br /> they shall determine, even though the term af such agreements or
<br /> leases shall eXtend beyond the term of their trust; and generally,
<br /> to exercise with respect to the continuance, management, sa�,e or
<br /> liquidation of any farm or real estate business which I may have,
<br /> all, of the powers which I myself could have exercised in my lifetime;
