<br /> At a session of the Co.unty Court held in and for said County of Hall
<br /> in the State of Nebraska this 28th day of April, 1967.
<br /> Present: Edward Dixon, County Judge.
<br /> - BE IT REMEMBERED, that E. H. Benson and Arthur C. Mayer,Co-executors,
<br /> filed herein tlieir final report as such co-executors, together with a
<br /> petition praying that said report be allowed, for a decree of heirship,
<br /> determination of inheritance tax, order of final distribution and final
<br /> settlement and discharge. For these purposes the 28th day of April,
<br /> 1967, at 10:00 o'clock a.m., in the County Court Room in said County
<br /> � wa.s assigned as the time and place for hearing said petition and examin-
<br /> ing arid allowing said fina� repbrt; and it was orderecl that notice of
<br /> � the pendency of such hearing be given as by law requiredi and it appears
<br /> by proof on file that notice was given as ordered by the Court, and that
<br /> no objections to sa3d final report have been made or filed. Upon examina-
<br /> tion of the evidence in this matter and beinq duly advised in the premises,
<br /> the Court finds as follows: That Mary E. Howe died on October 30, 1966,
<br /> testate, and a resident of Hal.l County, Nebraska; that the instrument
<br /> purporting to be the last wi1l. and testament of Mary E. Howe, deceased,
<br /> was filed in this court with a petition offering the same for probate
<br /> , and petitioning the court to appoint E. H. Benson and Arthur C. Mayer
<br /> Co-executors of this estate, and that an order of this Court was made
<br /> assigning the 2nd day of December, 1966 at 10:00 o'clock a.m. in the
<br /> , County Court Room of said county as the time and place for hearing said
<br /> petition, proving said Will, and admitting the same to probate and order-
<br /> ing that notice of the pendency of said hearing be given as by law re-
<br /> quired, and it appears by proof on file that notice of such order was
<br /> ;� so given.
<br /> ;; The Court further finds that on the 2nd day of December, 1966, said
<br /> instrument was proven, allowed, and admitted to probate as the last will
<br /> ';j and testament of Mary E. Howe, deceased, which Will is in words as

<br /> sound mind and disposing memory, do hereby Tnake, publish and declare
<br /> this to be my last will and testament, revoking any former wills made

<br /> "I appoint my daughters, Mary nowe Prescott and Anne Howe Hungerford,
<br /> Co-executrices of this Will. This apppintment is contingent upon one or
<br /> ;'� both of them residing in Hall County at or imme diately after my death.
<br /> If only one of my daughters should reside in Hall County at or immedi-
<br /> ately after my death, that daughter shall be sole executrix. If neither
<br /> of my daughters reside in Hall County at or immediately after my death,
<br /> '''�i I appoint E, H. Benson and Arthur C. Mayer, or either of them, executor
<br /> �';1 of this Will. I direct that none of the above named persons need furnish
<br /> � surety on their bond as executrix or executor. I also direct that all �
<br /> powers and discretion hereinafter granted my executrix or execu�or shall
<br /> ,� fully apply to any one of them, if only one should so serve, and to any
