<br /> This matter coming on for hearin� on the �_day of March,
<br /> 1967, on the Petition of Marie M. ISnglebrecht, for s determinetion of
<br /> inheritance t�x, and the evidence; John F. McCarthy, Attorney for Marie
<br /> M. Englebrecht, petitioner, appearing. in person and shows the Court as
<br /> follows:
<br /> That Elmer �snglebrecht, d�parted this life 8t Grand Ssland, Ne-
<br /> braska, on August 9, 1965, being at said time s resident of Hall CounCy,
<br /> Nebraska; that the petitioner is the wife ot said deceaeed; that at the
<br /> time of his d�ath, said deceased was not possesaed of any property sub-
<br /> ject to administration in the State of Nebraska, but w�s the owner, to-
<br /> gether with petitioner, as joint tenants, of the following-described
<br /> property, to-wit:
<br /> LaC One Hundred Four (104) in West Lawn, an Addition to the
<br /> City of Grand Island, Nebraska;
<br /> which property, at the time of the death of said dece�sed, was of the
<br /> fair and reasonabie market value of $11,650.00.
<br /> That s8id dece8sed did not, dur3.ng his lifetime, convey any prop-
<br /> erty in trust, or otherwise, in contemplation of death or intended to
<br /> take effect in possession or enjoyunent after death, and neither your
<br /> petitioner nor any other person became entitled to any property by reason
<br /> of the death of deceased.
<br /> That the petitioner was the owner of a home in her own name be-
<br /> fore the marriage and that she sold this home for $900.00, end that
<br /> sh� hac� $Z5Q0.00 in the bank which she had saved and that she contr�.buted
<br /> this amount to the purchase of the property descri�ed herein.
<br /> That the property described herein as Lot One Hundred Four (104)
<br /> in Weat Lawn, an Addition to the City of Grand Island, Nebraska, con�ti-
<br /> tuted the homestead of the deceased snd was exempt to I�Iarie M. Englebrecht,
<br /> as surviving spousee
<br /> That s�id property is held by Elmer Englebrecht and Marie M.
<br /> Englebrecht.
<br /> That this is all of the property owned by the deceased or peeitioner,
<br /> or property in which either of them had any interest a� the time of tr�e
<br /> death of Elmer Englebrecht.
<br /> .
<br /> The Court further finds th8t the County Attorne}; o� I3a11 Count�,
<br /> Nebraska, has entered his Voluntary Appearance in the above-entitled
<br /> proceeding on behalf of the County of Hsll and State of Nebrasks, �a�iving
<br /> the service upon him to show cause for the determination of inheritance
<br /> tax.
<br /> IT IS THEI�EFORE C�NSIDERED, ORDERED, ADJUDGED, AND DECREED BY
<br /> THE COURT, th�tt:` there is':no liability for inheritance tax by reason
<br /> of the transfer of the above•de�cribed property because of the c��a�h
<br /> of said deceased, and;;that the above-described property passed to �he
<br /> surviving jo�:nt ten�nt free and clear of sny inheritance tax.
