<br /> in the State of Nebraska this 16th day of March, 1967.

<br /> BE IT REMEMBERED, that Albert Hehnke, executor, filed herein his
<br /> final report as such executor, together with a petition praying that said
<br /> report be allowed, for a decree of heirship, determination of inheritance
<br /> tax, order of final distribution and final settl.ement and discharge. For
<br /> �hese purposes the 16th day of March, 1967, at 10:00 o'clock a.m., in the
<br /> County Court Room in said County was assigned as the time and place for
<br /> hearing said petition and examining and allowing said final report; and
<br /> it was ordered that notice of the pendency of such hearing be given as

<br /> as ordered by the Court, and that no objections to said final report
<br /> have been made or filed. Upon examination of the evidence in this matter
<br /> and being duly advised in the premises, the Court finds as follows: That
<br /> Thresia Hehnke died on September 5, 1966, testate, and a resident of Hall
<br /> County, Nebraska; that Albert Hehnke filed in this court instruments pur-
<br /> porting. to be the last will and testament and codicil thereto of Thresia
<br /> i Hehnke, deceased, and a petition offering the same for probate, and peti=
<br /> tioning the Court to appoint him executor of this estate, and that an
<br /> order of this Court was made assigning the 7th day of October, 1966 at
<br /> 10:00 o'clock a.m. in the County Court Room of said county as the time
<br /> and place for hearing said petition, proving said Will and Codicil, and
<br />'' admitting the same to probate and ordering that notice of the pendency
<br />,,,���' of said hearing be given as by law required, and it appears by proof on
<br /> 1 file that notice of such order was so given.
<br />�IThe Court further finds that on the 7th day of October, 1966, said
<br /> . instruments were proven, allowed, and admitted to probate as the last
<br /> I will and testament and codicil thereto of Thresia Hehnke, deceased, which
<br /> will and codicil are in words as follows:
<br /> "LAST WILL AN D TESTAMENT
<br /> °I, Thresia Hehnke, a widow, of Grand Island, Nebraska, being of
<br /> sound mind and disposing memory, do hereby make, publish and declare this
<br /> my Last Will and Testament, in words as follows:
<br /> I.
<br /> "I hereby appoint my son, Albert Hehnke, Executor of this Will and
<br /> expressly provide that he need f urnish no surety on his bond as such; I
<br /> hereby direct him to pay the expenses of my last illness and burial, all
<br /> debts legally enforcible against my estate and to select, have erected
<br /> and pay for a suitable marker at my rave he t

<br /> "I hereby authorize and empower my said Executor to sell so much of
<br /> my personal property as may be necessary for the payment of the above and
<br /> so much more as in his opinion is for the best interests of my estate,
<br /> without first procuring an order or authority from any Court for such
<br /> purpose,
<br /> "Unto my dear daughter, Irene Webster, 'who is a widow, and who makes
<br /> her home with me, and has for some years past, I hereby devise my home
<br /> complete including al1 household furniture, furnishings and equipment
<br /> therein contained, the legal description of which is: Lot Five (5) in
<br /> Block One (1), in Wiebe' s Addition in the City of Grand Island, Hall
<br /> County, Nebraska, all to her in fee simple absolute, subject only �o a
<br /> charge in the sum of Two Thousand Dollars ($2,000.00) in favor of my said
<br /> Executor, which my said daughter Irene Webster shall pay without interest
<br /> within six months from the date of my death; in the event that my said
<br /> daughter Irene shall fail to make such payment, then this devise to be
<br /> of no force and effect, and then I hereby devise said property to my said
