<br /> Now on thie _�� day of February, 1967, this eauge came
<br /> on �or hearing upon the nel eccount end petition for d�cree of
<br /> distribution and diseharge of Elaie C. Wieck, the duly appointed,
<br /> qu�lified and ecti.ng executrix of the estate df Frank H. R. Wieck,
<br /> also known �s Frank Wieek, deceased, and the Court having examined
<br /> the recorda, pleadings, proceedinga and proog on file herein, and
<br /> having heard the evidence in support thereof� and being fully ad-
<br /> vised in the prem��ee, finde that:
<br /> 1. Due and legal notice of the time and pl�ce of this hearing
<br /> has been given to e11 pereons interes�ed in saifl estate by publication
<br /> in The Grend I�land Da11y Independant for three successive weeks , and
<br /> additional notice in the manner required by law, and no ab�ections
<br /> have been filed to seld account, or to eaid petition.
<br /> 2. The final account is true, correct and complete in all
<br /> reapeeta ; it should be approved and allowed es the executrix's final
<br /> account; s11 of her aets and deeds as �xecutrix ahould be approved ;
<br /> the estate should be settled and closed; and, upon the filing of her
<br /> final reeeip-t� her�in es executrix� the s�id executrix should be dis- ,
<br /> charged and the Iiability of �aid executrix on her bond should be ter-
<br /> minated and h�r bond released.
<br /> 3. Due and legal notice wea given to creditors, as provided
<br /> by law, to pres�snt their claims and demands against said estate, and
<br /> that such time haa Yully expircd: that four claims were filed against
<br /> the eetate; that all four were allowed and paid in full; that a decree
<br /> barring other claims, not filed within th� time allowed by law, was
<br /> heretofore entered on December 21 , 1959; �nd that there are now due
<br /> and owin� by the eetate, certain admini�trative costs, �eea, �nd ex-
<br /> penses, which should be paia at this titne.
<br /> 4. The eaid Frank Wieck was, at the time of his death, a
<br /> re�ident and e citi2en of Hall County� IJebraske, and he left sur-
<br /> viving him� a� hi� eole and only he3.rs-at-law and benefic�ies, both
<br /> of whom are of l�gal age, the following, namely:
<br /> ELSIE G. WIECK, his wife, of Hall County, N�breska , and
<br /> PAUL ROBERT WIECK, his son, fortner�y of �awlings, �"yoming;
<br /> and now of Washington, D.C. ;
<br /> and the deceased was not aurvived by any other children, or by any
<br /> children of a deceased child.
<br /> 5. The said Frank H. R. Wieck, also known a� �rank �Viec��,
<br /> died testate, leavin� a Last Will aMd Teetement, dated May 23, 195� �
<br /> that the said Frank Wieck, deceased, was posseesed of full testamen-
<br /> tary capacity at the time of the execution of �aid will, and that
<br /> said instrument was duly executed and witnessed as required by the lawa
<br /> of the� :�tate of Nebraeka , and has been duly admitted to probate herein.
<br /> 6. The aaid Frank Wieck owned the following aescribed re 1
<br /> estate, which real est�te w�s, at the time of�ub�ect�to�aelife�esta�e
<br /> lien of 4/�5�hs oY the value of' the �ame and �
<br /> in Wiebke Wieck, aurviving epouse of Peter Wieck, deceased, who died
<br /> �ecember 1, 1965, to-wit :
