<br />   		Myrtle A.  Cox,  deceased,  were  filed for probate in this Court.   That on
<br />   		the lst day o   September,  1966,  said instruments to which tM s certifi-
<br />   		cate is attac ed were  duly proved,  probated and allowed as �he last
<br />   		wil]. and test   ent and codicil thereto of  the real  and personal estate
<br />   		of  said Myrtl   A.  Cox,  deceased,  and the  same were ordered to be re-
<br />   		corded in the records of  the Court aforesaid.

<br />   		and the  said   ommercial National  Bank and Trust Company was appointed
<br />   		executor and   urnished bond as  required and a.pproved by the Court.   The
<br />   		Court finds  t at D4yrtle A.  Cox was an unremarried widow at the time of
<br />   		her death and that  she left her surviving as her sole and only heirs-
<br />   		at-law the  fo lowing  five  children:   Albert Lynn Cox,  sonf  Walter
<br />   		Bedford Cox,  �on;  Florence Hartman,  daughter;  Gordon Bayard Cox,  son;and
<br />   		Dorothy Ruth �larmer,  daughter.

<br />    			The Cou     f urther finds  that on the  lst  day of  September,  1966,  an
<br />   		order of this  court was made allowing creditors  until the  28th day of
<br />   		December,  196   within which to  file  claims,  and allowing  said executor
<br />   		one year with'n which to  settle  said estate,  and further ordering that
<br />   		notice  to  cre  itors be published as by law required,  and that a hearing
<br />       '   	on  claims  fil  d against  said estate be held at  the office of  the County
<br />   		Judge of Hall County,  Nebraska on the  29th day of  December,  1966  at
<br />   		9:00 o' clock a.m.  and it appears by proof  on file  that  such notice was
<br />   		published as drdered by this  Court.
<br />    			The Cou   �  further finds  that the executor filed herein its  inven-
<br />   		tory of the �sets of this estate,  together with a  copy thereof  for
<br />   		the County As�essor of Hall County,  Nebraska,  and that according  to
<br />   		said inventor•�} said deceased died  seized and possessed of  the  follow-
<br />   		ing described real estate:

<br />    			The West�rly Forty-Eight Feet  (W48' )  of Lot Six  (6) ,  in
<br />    			Block Ele,�ven  (11)  in the Village  of  Doniphan,  Hall County,
<br />   			Nebraska i
<br />   					i
<br />    			The Court'  f urther finds  that on the  29th day of  December,  1966  an
<br />   		order of  thisjcourt was made barring  claims which might be filed against
<br />   		this estate  an(d allowing �our claims.   The  court finds that  said four
<br />   		claims have b�en paid,  together with court  costs.   The Court  further
<br />   		finds that pursuant  to  the provisions of  the  last will  and testament
<br />   		and codicil  tliereto  of  said deceased,  that all  net assets of  this  estate
<br />   		passed to the ;five  children of  said deceased,  who are:   Albert Lyn�n
<br />   		Cox,  Walter B�d:Eord Cox,  Florence Hartman,  Gordon Bayard Cox,  and Dorothy
<br />   		Ruth Farmer,  i�n equal  shares.

<br />    			The Cour�  further finds  that each of  said five  children is entitled
<br />   		to  an examptio�n from Nebraska  inheritance  tax in the amount of  $10,000.00;
<br />   		that the real �estate owned by  said deceased had a fair market value  as
<br />   		of her death df  $3,100.00;  that the net value  of the distributive  share
<br />   		passing to ea�h of  said  children  under the provisions of  the Will  and
<br />   		Codicil  of  sa.'��d deceased,  together with the  respective  shares of  jointly
<br />   		owned or co-owrned property passing to  said five  children,  as  set forth in
<br />   		the  inventory filed herein,  do not exceed the  statutory exemption to
<br />   		which each of Isaid  children  is  entitled;  therefore,  the  court finds  that
<br />   		there is no Nebraska inherita.nce  tax  due or owing  in this estate.
<br />     	�      	The Court  further finds  that Mayer & Mayer,  attorneys for the ex-
<br />   		ecutor and fo�* said estate,  are  entitled to  attorneys'  fees herein in
<br />   		the amount ofl$711.53,  and that the Commercial National  Bank and Trust
<br />   		Company is ent�itled to  an executor's  fee herein in the amount of  $370.96.
<br />   		That personal �taxes owing by  said deceased and  said estate  for the years
<br />   		1a63  tnrough 1967,  inclusive,  were  in the  amount of  $131.99,  and that
<br />   		such taxes ha�e been paid by the  executor subsequent to  filing of  its  final
<br />   		report,  that  �uch expenditures  should be a.11owed,  and that  certificates
<br />   		pertaining to �personal  taYes,  as  required by law,  have been filed herein
<br />   		by the County �Assessor arid County Treasurer of Hall County,  Nebraska.
<br />   			The Courtifurther finds  that  copies of  all published legal notices
<br />   		have b�en  sent� to all  interested parties  during the administration of
<br />   		this estate as by law required,  and that affidavits pertaining thereto
<br />   		are on file he�rein.
