<br />EASEMENT AND RIGHT -OF -WAY
<br />r
<br />KNOW ALL MEN BY THESE PRESENTS, that CRUMRINE ENTERPRISES, LTD., a
<br />Nebraska limited partnership, GRANTOR; together with FIVE POINTS BANK, a Nebraska
<br />banking corporation, LENDER; for valuable consideration, receipt of which is hereby
<br />acknowledged, does hereby give, grant, and convey unto the VILLAGE OF ALDA,
<br />NEBRASKA, a municipal corporation, GRANTEE, a perpetual easement and right -of -way over,
<br />across, under, through, and upon the following- described real estate, to -wit:
<br />A PARCEL OF LAND LOCATED IN LOT 2, CRUMRINE SECOND
<br />SUBDIVISION IN THE VILLAGE OF ALDA, HALL COUNTY, NEBRASKA,
<br />BEING DESCRIBED AS FOLLOWS: REFERRING TO THE SOUTHEAST
<br />CORNER OF LOT 2, CRUMRINE SECOND SUBDIVISION; THENCE
<br />N01°09'21"W (ASSUMED BEARING) ON THE EAST LINE OF SAID LOT 2,
<br />A DISTANCE OF 99.69 FEET TO THE POINT OF BEGINNING; THENCE
<br />CONTINUING N01°09'21"W ON SAID EAST LINE, A DISTANCE OF 30.00
<br />FEET; THENCE S87 °58'45 "W, A DISTANCE OF 249.25 FEET TO THE WEST
<br />LINE OF SAID LOT 2; THENCE S01 °14'02 "E ON SAID WEST LINE, A
<br />DISTANCE OF 30.00 FEET; THENCE N87 °58'45 "E, A DISTANCE OF 249.21
<br />FEET TO THE POINT OF BEGINNING, CONTAINING 0.17 ACRES, MORE
<br />OR LESS.
<br />Said easement includes but is not limited to the right to install, construct, maintain,
<br />replace, and operate a sewer line or lines by the GRANTEE within the described easement area
<br />in connection with its public sewage disposal system. It is further provided that said easement
<br />shall be deemed to provide GRANTEE with the right of unrestricted access to its sewer line or
<br />lines by ingress and egress over, across, through, and under the lands described herein, together
<br />with all rights of ingress and egress necessary for the full and complete use, occupation, and
<br />enjoyment of the easement hereby granted, including the right to excavate and refill ditches and
<br />trenches for the location of said sewer line or lines and appurtenant structures related thereto.
<br />To have and to hold the same unto the said GRANTEE and its successors and assigns as
<br />appurtenant to the land and every part thereof; and GRANTOR and LENDER hereby dedicate
<br />their respective interests in said real estate to the use of the GRANTEE. This easement is
<br />perpetual and shall run with the land.
<br />In addition to the perpetual easement granted hereinabove, GRANTOR, for the purpose
<br />of permitting initial construction, stockpiling of materials, parking of equipment, and
<br />encroachment necessary to initially install pipes and related equipment for such sewer line,
<br />grants and conveys unto GRANTEE a temporary construction easement ( "Temporary
<br />Easement ") over, through, and across that real estate described as:
<br />A PARCEL OF LAND LOCATED IN LOT 2, CRUMRINE SECOND
<br />SUBDIVISION IN THE VILLAGE OF ALDA, HALL COUNTY, NEBRASKA,
<br />BEING DESCRIBED AS FOLLOWS: REFERRING TO THE SOUTHEAST
<br />CORNER OF LOT 2, CRUMRINE SECOND SUBDIVISION; THENCE
<br />N01°09'21"W (ASSUMED BEARING) ON THE EAST LINE OF SAID LOT 2,
<br />A DISTANCE OF 84.69 FEET TO THE POINT OF BEGINNING; THENCE
<br />S87 °58'45 "W, A DISTANCE OF 249.19 FEET TO THE WEST LINE OF SAID
<br />LOT 2; THENCE N01 °14'02 "W ON SAID WEST LINE, A DISTANCE OF
<br />15.00 FEET; THENCE N87 °58'45 "E, A DISTANCE OF 249.21 FEET TO SAID
<br />EAST LINE; THENCE S01 °09'21 "E ON SAID EAST LINE, A DISTANCE OF
<br />15.00 FEET TO THE POINT OF BEGINNING, CONTAINING 0.08 ACRES,
