<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That the STATE OF NEBRASKA, by and through the DEPARTMENT OF ADMINISTRATIVE SERVICES, an
<br />agency of the STATE OF NEBRASKA, hereinafter referred to as "Grantor," in consideration of $1.00, receipt
<br />of which is hereby acknowledged, and the further payment for damages as described in the terms and
<br />conditions and the placement of other necessary equipment when set on the following described property,
<br />does hereby grant, bargain, sell, and convey unto the CITY OF GRAND ISLAND, a municipality organized
<br />under and pursuant to the laws of the State of Nebraska, hereinafter referred to as "Grantee," and its
<br />employees, officers, affiliates, contractors, agents and /or assigns, hereinafter "Grantee Parties ", whether
<br />one or more, the privilege of requesting (1) a 637 square feet right -of -way from the State of Nebraska at
<br />the intersection of Webb Road for construction of a sidewalk conforming to American's with Disability Act
<br />(ADA) standards and a signal pole relocation and (2) to acquire 33,188 square feet in five (5) temporary
<br />easements for minor grading/shaping work and for relocating the west driveway to the United Veterans'
<br />Club, collectively the "Project," which is planned to begin in 2015.
<br />This request is part of the initial phase of the Capital Avenue street widening project on the south side of
<br />the campus along Capital Avenue, on or adjacent to property owned by Grantor and, whereas, it may be
<br />necessary for the City, its officers, agents, employees, contractors, subcontractors, and authorized
<br />representatives to temporarily enter upon, travel over, excavate, clear, backfill, store materials upon, and
<br />otherwise use the lands herein described which are owned by Grantor during the aforementioned
<br />construction Project, situated in Hall County, Nebraska, collectively hereinafter "Property," described as
<br />follows:

<br />A TRACT OF LAND CONSISTING OF PART ON AN UNPLATTED TRACT LOCATED IN THE SOUTH HALF
<br />(51/2) OF FRACTIONAL SECTION 6, TOWNSHIP 11 NORTH, RANGE 9 WEST, CITY OF GRAND ISLAND,
<br />HALL COUNTY, NEBRASKA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:
<br />COMMENCING AT THE SOUTHWEST CORNER OF SAID FRACTIONAL SECTION 6; THENCE ON AN
<br />ASSUMED BEARING OF N01 °33'03 "W ALONG THE WEST LINE OF SAID SECTION 6 A DISTANCE OF
