<br /> At a session of the County Court held in and for said County of
<br /> Hall in the State of Nebraska this 13th day of October, 1967. ,
<br /> Present: Edward Dixon, County Judge.
<br /> BE IT REMEMBERED, that Mary Grace Moslander, executrix, filed here-
<br /> in her f inal report as such executrix, tocether with a petition pray-
<br /> ing that said report be allowed, for a decree of heirship, determina-
<br /> tion of inheritance tax, order of final distribution and final settle-
<br /> ment and discharge. For these purposes the 13th day of October, 1967
<br /> at 10:00 o'clock a.m. in the County Court Room in said County was
<br /> assigned as the time and �lace for hearing said petition and examin-
<br /> ing and allowing said final report; and it was ordered tha-t notice of
<br /> the pendency of such hearing be given as by law required; and it ap-
<br /> pears by proof on file that notice was given as ordered by the Court,
<br /> and that no objections to said final report have been made or filed.
<br /> U�on e:camination of the record and evidence in this matter, and being
<br /> duly advised in the premises, the Court finds as follows: That James
<br /> A. M�slander died on April 12, 1967, testate, and a resident of Hall
<br /> County, Nebraska; that r'Iary Gra.ce D�oslander filed in this Court instru-
<br /> ments purporting to be the Last Will and Testament and Codicil thereto
<br /> of James A. Moslander, deceased, and a petition offering the same for
<br /> probate and petitioning the Court to appoint her executrix of this
<br /> estate, and that an order of this Court ��as made assignirg the 12th day
<br /> of May, 1967 at 10:00 o'clock a.m. in the County Court Room of said
<br /> county as the time and place for hearing said petition, proving said
<br /> will, and admitting the same to probate, ar_d ordering that notice of the
<br /> pendency of said hearing be given as �y law required, and it appears by
<br /> proof on file that notice of such order was so given.
<br /> The Court further f inds that on the 12th day of May, 1967, said
<br /> instruments were proven, allowed, and adr.litted to probate as the last
<br /> will and testament and codicil thereto of James A. Mc�slander, deceased,
<br /> which Will and Codicil are in words as follo`vs:
<br /> "LAST WILL AL'��D TESTAI`^:ENT OF JAD4ES A. MOSLAND�R
<br /> ' "I James A. Dioslander, of Grand Island, �all County, Nebraska, being
<br /> of sound mind and disposir.g nemory, do iiereby make, publish and declare
<br /> this to be my last will and 'c�=sta.ment, revo]cing any former wills made by
<br /> me, in words as follows�
<br /> I.
<br /> "I appoint my dear wife, �Iary Grace ��oslander, executrix of this
<br /> will. In the event tnat she should be unable to so serve or complete
<br /> her duties as executrix, I appoint oLr ch�ldren, James A, bioslander, Jx. ,
<br /> and Grace Moslander I'rei, as alternate or successor executors. I direct
<br /> that neither my wife nor any child of mine need furnish surety as execu-
<br /> trix or executor. Al1 powars a.nd discretion hereinafter granted my wife,
<br /> as executrix, shall fully e:ii�end and be applicable to our children, or
<br /> either of them as alternat� or successor e.�ecutors, and to any admin-
<br /> istrator with the will annax;ed. .
<br /> II.
<br /> "I direct my executrix to pay all debts which are legally enforce-
<br /> able against my estate, as �.00n after my death as may be convenient,
<br /> I direct that any inheritance taxes and Federal estate taxes shall be
<br /> charged to and payable out o� that portion of my estate in which my wife
<br /> is hereinafter granted a life esta-�e.
