D <br />ut <br />Ln <br />E <br />0 <br />Homeowner <br />Homeowner <br />Homeowner <br />AMENDMENT TO DECLARATION <br />Hom ner <br />. 6(4 <br />caner <br />Homeowner <br />CD 03 <br />C A <br />rrn <br />The following signers, consisting of more than one -half (1/2) of the Units, hereby amend the Declaration filed at 77- <br />007403 of the Records of Hall County, Nebraska as to the following described real property, to -wit: <br />That part of Riverside Estates Unit 1, a subdivision as surveyed, platted and recorded in part of the SW Y4 of <br />Section 28, Township 14 North, Range 9 West of the 6 P.M., Hall County, Nebraska, lying South of the <br />South R.O.W line of Stagecoach Road and lying East of the West lot line of Lot 46, extended Southward to <br />the South line of said Riverside Estates Unit 1. <br />ARTICLE IV COVENANT FOR MAINTENANCE ASSESSMENTS shall be replaced with the following: <br />ARTICLE IV <br />COVENANT FOR MAINTENANCE ASSESSMENTS <br />Section 5. Special Assessments for Capital Improvements and Extraordinary Expenses. <br />In addition to the annual assessments authorized in Sections 3 and 4 above, the Association may levy a special <br />assessment for the purpose of defraying, in whole or in part, the cost of any construction, reconstruction, repair or <br />replacement of a capital improvement upon the Common Area, induding fixtures and personal property related thereto or <br />to defray in whole or in part any extraordinary general expenses of the Assodation, provided that any such assessment shall <br />have the assent of three - fourths (3/4) of the vote of each dass of members who are voting in person or by proxy at a <br />meeting called for this purpose. Approval of the project, cost, and the length of time for payment of the assessment shall <br />require a vote of the Association following the requirements stated in this Article. Each such assessment shall be paid during <br />the approved term. A proportionate share of the total assessment divided by the length of payment, in months, shall be <br />paid quarterly. The first payment of such assessments shall be due and payable one month from the date of levy with a like <br />sum due and payable each and every quarter thereafter, along with the regular assessment with respect to said Lot, until <br />said assessment shall be paid in full. In no event shall the payment exceed five (5) years. <br />All of the remaining provisions of said Declaration and any amendments previously approved, not contrary to the <br />aforementioned Amendment, shall remain in full force and effect. <br />
