I I <br />c rZ'Z` <br />DRIVEWAY EASEMENT AGREEMNT <br />-.t; r r, <br />CA) <br />N <br />CO <br />F-+ <br />re) <br />This Driveway Easement Agreement (the "Agreement ") is made and entered into <br />this fe #4 day of May, 2014 by and between Michael S. Williams and Sandy S. Williams, <br />husband and wife, ( "Williams "), who have an address of 2920 Bock Avenue, Grand <br />Island, Nebraska 68803 and J. Larry Fugate, As Trustee of the J. Larry Fugate Revocable <br />Trust Dated March 25, 2010 ( "Fugate "), having an address of 208 South Maize Road, <br />Wichita, Kansas 67209. <br />WHEREAS, Williams own a parcel of land in Hall County, Nebraska legally <br />described on Exhibit "A" attached hereto and made a part hereof (the "Williams' <br />Tract "); and <br />WHEREAS, Fugate owns a parcel of land in Hall County, Nebraska also <br />described on Exhibit "A" attached hereto and made a part hereof (the "Fugate Tract "); <br />and <br />WHEREAS, just prior to recording this Agreement, Williams owned both the <br />Willams' Tract and the Fugate Tract; and <br />WHEREAS, Williams had previously constructed a driveway consisting of <br />approximately 44 feet in width with approximately 34 feet being located on the Willams <br />Tract and approximately 10 feet being located on the Fugate Tract (collectively the <br />Easement Tract); and <br />WHEREAS, the parties wish to grant each to the other the right of ingress, egress <br />and regress over the existing driveway. <br />NOW, THEREFORE, in consideration of the mutual covenants and conditions set <br />forth herein, Williams and Fugate agree as follows: <br />1. Williams hereby grants to Fugate, his heirs, successors and assigns, for the <br />benefit of the Fugate Tract including the use by the customers and invitees of Fugate, a <br />
