Hazardaus Su bstan�es.As used in this Section�1: �a} "Haza�dou.s�'u�.s�a►�ce.s"are those substances <br /> defined as toxic ar ha�ardous sub�tances,p�llutants,or wastes by Environm�ntal Law and the f��lo�ving <br /> substances:gasoline,kerosene,��her flammable or tox�c petroleum products,t�xic pesticides and h�rbicides, <br /> volat��e solveats, materials contai�ing asbestas or f�rmaldehyde, and radioactive materials; �b} <br /> "Er�viror�nae�atal Law"means federallaws�.nd laws of the jurisdictian�vhere the Property is l�cated that <br /> relate to health, safety or environmental protection; (c} ".,��rcviror�rraerctal Clearcu�"includes any response <br /> action, re�medial action, or r�moval action, as defined in Envir�nmental Law; and(d}an "�r�vira�►nental <br /> �Co►�ditior�"means a�vndition that can cau�e,con�ri�aute to, or otherw�se trigger an Environxnental Cleanup. <br /> B�rrower shall not cause or permit th�presence,use,disposat, stora.ge,�r release of any Hazardaus <br /> Substances,or threaten to re�ease any Hazardous Substances,on or in�he Froperty.Borrower sha11 not do, <br /> nor a11ow anyone else t�do,anything affecting the Pr�perty(a�that is in vialation af any En�r�ronmenta� <br /> Law, (b}which creates an En�ir�nmental�ondition,or��)which,due t�the presence,use,ar r��ease af a <br /> Ha.�ardous Substance,creates a condition that adversel�affects the value�f the Property. The preceding two <br /> sentence�shall not ap�l�to t�.e presence,use,or storage on the Pr�perty of�rna11 quantities of Hazardous <br /> �ubstances tb�at axe general�y recognized tv�e appropr�ate ta nvrma�r�sid�ntial uses and to maintenance of <br /> the Prapert��including,but not lirnited to,hazardaus substances�n con�urner praducts}. <br /> �onawer shall prompt�y g��e Leader written not�c�of(a�an}�investigatian,claim,demand,Iawsuit or other <br /> action by any governmen�al or regulatory agency o�'priva�e party in�o�vin�the Praperty and any Hazardous <br /> �ubstanc�or Environmental Law of which Borrower has actual know�edge, (b�any�nvironm�nta� <br /> Condition, including�ut not limited ta,any spill�ng, leakin�,di�charge,release or threat�f release of an.y <br /> Hazardvus Subs#ance,and[c�any eondition�aused by the presenc�,u�e or re�ease af a Ha�ardaus Substance <br /> wh�ch adversely affects the value of the Prop�rty. If Borra�rer learns,or�s n.atified by any governmental or <br /> regulato�ry authority,or any private�arty,that any rema�al or othe�remediation of an}��Iazard�t�s Substan�e <br /> affecting the Pr�per�y is nec�ssar}�,Borrower sha11 promptly take a11 necessary remedial aetions in <br /> accordance with Environmen�a�Law.Nothing herein sha�l create any ob�igation on Lender for an <br /> Enviranmental�leanu�. <br /> Non-Unifvrm�o�enants.Borrower and Lender covenant and agree as follows: <br /> 22.
