0 <br />0 <br />N <br />and <br />-n <br />C <br />z <br />D <br />in in <br />r- ' <br />r• <br />PARTIAL RELEASE OF DECLARATION OF TRUST <br />CD oo <br />CD -A <br />rn <br />e1 <br />Whereas, The Hall County Housing Authority ( "PHA "), a public body corporate and <br />politic, duly created and organized pursuant to and in accordance with the provisions of the laws of <br />the State of Nebraska and the United States of America, Secretary of Housing and Urban <br />Development ( "HUD ") pursuant to the United States Housing Act of 1937 (42 U.S.C. 1437, et seq.) <br />and the Department of Housing and Urban Development Act (5 U.S.C. 624) entered into (i) <br />Declaration of Trust dated June 21, 1994, and recorded October 21, 1994, as Document No. 94- <br />108619, Deed Records, Hall County, Nebraska; (the "Declaration of Trust "); and <br />Whereas, the Declaration of Trust provides that the PHA may, with the approval of HUD, <br />release in whole or in part any project from the trust created by the Declaration of Trust with the <br />endorsement by a duly authorized officer of HUD upon any instrument of release of any project; <br />Whereas, the property to be released is more particularly described in Exhibit A, which is <br />attached and incorporated as if fully set forth herein; and <br />Now Therefore, HUD and the PHA do hereby acknowledge and declare that the PHA is <br />released of all obligations to hold the property described in Exhibit A in trust for the benefit of <br />HUD under the Declaration of Trust. <br />Pursuant to the terms of the Declaration of Trust, the endorsement by a duly authorized <br />agent of HUD upon any instrument of release made by the PHA of any project shall be effective to <br />release such property from the trust created by a Declaration of Trust, which shall terminate and no <br />longer be effective as to the property being released, the legal description of which is set forth in <br />Exhibit A. <br />The release of the property described in Exhibit A from the Declaration of Trust shall not <br />affect in any way the lien, operation or effect of the Declaration of Trust upon the remainder of the <br />Site not released hereby or released earlier, and the Declaration of Trust shall remain in full force <br />and effect as to the residue of the site, if any, not hereby expressly released. <br />r�rr <br />z <br />
