Davis, being of lawful age and sound mind, and, having been first <br />duly sworn, states the following: <br />1. I am the duly authorized and acting Attorney -in -Fact for Benjamin R. Davis under a written <br />Power of Attorney dated June 4, 2007 and Adrienne M. Tranel under a written Power of <br />Attorney dated October 18, 2011; <br />2. Said principal is the proposed trustor under a Deed of Trust covering the following described <br />property: <br />Parcel A: <br />Lot Three (3) in Block One Hundred Five (105) in Railroad Addition to the City of Grand Island, Hall <br />County, Nebraska, together with ingress and egress rights over the Southerly Ten (10) Feet of Lot Two (2) <br />in said Block One Hundred Five (105) as specifically provided in Agreement recorded in Book 6, of <br />Miscellaneous Records at Page 7, recorded in the office of the Register of Deeds of Hall County, <br />Nebraska. <br />Parcel B: <br />Lot Five (5) and Fractional Lot Six (6) in Fractional Block One Hundred Five (105) in Railroad Addition to <br />the City of Grand Island, Nebraska. <br />Gi 3. Said Power of Attorney authorizes me to act on behalf of the principal for the purpose of <br />mortgaging the above described property, and to execute all instruments necessary in the <br />performance of said authority; <br />4. Concurrent with the execution hereof, I have exercised the authority vested in me by virtue of <br />said Power of Attorney by executing a Deed of Trust to Exchange Bank; <br />5. As of the time and date of the execution of said Deed of Trust, said Principal was alive, and I <br />have no knowledge, actual or otherwise, of the death of said Principal, nor any knowledge, <br />actual or otherwise, of termination by revocation of said Power of Attorney; and <br />6.
