Lender and Trustor have entered into an Assignment of Rents dated October 22, 2013 <br />(the "Assignment of Rents ") which has been recorded in Hall County, State of Nebraska, as follows: <br />Recorded on October 25, 2013 at Hall County Register of Deeds as Instrument No. 201308560. <br />REAL PROPERTY DESCRIPTION. The Assignment of Rents covers the following described real property located <br />in Hall County, State of Nebraska: <br />A tract of land located in Fractional Lot One (1), in Fractional Block One Hundred Twenty (120), in Railroad <br />Addition to the City of Grand Island, Hall County, Nebraska and its complement, to -wit: Fractional Lot One (1), <br />in Fractional Block Twenty (20), in Arnold and Abbott' s Addition to the City of Grand Island, Hall County, <br />Nebraska described as follows: Beginning at the Southwest corner of said lots; thence northeasterly a distance <br />of 55.00 feet along the south line of said Lots; thence northwesterly deflecting 90° 00' 00" left, a distance of <br />85.00 feet; thence westerly deflecting 45° 00' 00" left, a distance of 56.57 feet; thence southwesterly <br />deflection 45° 00' 00 , left a distance of 15.00 feet to a point on the west line of said lots; thence southeasterly <br />deflecting 90° 00' 00" left, a distance of 125.00 feet along the west line of said lots to the point of beginning <br />AND <br />Fractional Lot Two (2), in Fractional Block One Hundred Twenty (120), in Railroad Addition and its complement <br />to wit: Fractional Lot Two (2), in Fractional Block Twenty (20), in Arnold and Abbot's Addition, both being <br />additions to the City of Grand Island, Hall County, Nebraska EXCEPTING a tract more particularly described in <br />Warranty Deed recorded as Document No. 200607314 <br />FOR RECORDER'S USE ONLY <br />The Real Property or its address is commonly known as 1007 W 2nd Street, Grand Island NE 68801 -5821. <br />MODIFICATION. Lender and Trustor hereby modify the Assignment of Rents aw#oiltlwsa =. `. <br />Correction on Legal description. <br />CONTINUING VALIDITY. Except as expressly modified above, the terms of the original Assignment ofFtents shall <br />remain unchanged and in full force and effect. Consent by Lender to this Modification does not waive Lender's right <br />to require strict performance of the Assignment of Rents as changed above nor obligate Lender to make any future <br />modifications. Nothing in this Modification shall constitute a satisfaction of the promissory note or other credit <br />agreement secured by the Assignment of Rents (the "Note "). It is the intention of Lender to retain as liable all <br />parties to the Assignment of Rents and all parties, makers and endorsers to the Note, including accommodation <br />parties, unless a party is expressly released by Lender in writing. Any maker or endorser, including accommodation <br />makers, shall not be released by virtue of this Modification. If any person who signed the original Assignment of <br />Rents does not sign this Modification, then all persons signing below acknowledge that this Modification is given <br />conditionally, based on the representation to Lender that the non - signing person consents to the changes and <br />provisions of this Modification or otherwise will not be released by it. This waiver applies not only to any initial <br />extension or modification, but also to all such subsequent actions. <br />TRUSTOR ACKNOWLEDGES HAVING READ ALL THE PROVISIONS OF THIS MODIFICATION OF <br />ASSIGNMENT OF RENTS AND TRUSTOR AGREES TO ITS TERMS. THIS MODIFICATION OF ASSIGNMENT <br />OF RENTS IS DATED APRIL 14, 2014. <br />
