Page 1 of ( <br />3 <br />201402481 <br />7. MOBILE HOME: The parties are the owners of a Mobile Home, located at Lot <br />#69, Kingswood Estates, Grand Island, Nebraska. The Petitioner shall receive as her sole <br />and separate property this 1973 Flamingo Mobile Home, VIN #XGB229769. She shall pay <br />and shall hold the husband free and harmless from any and all liability for any loans or <br />encumbrances against said Mobile Home, which include the payments required by the <br />Purchase Agreement attached to this Property Settlement Agreement as Exhibit "A" by <br />making the payments as they become due and payable. <br />8. REAL ESTATE: The parties, as joint tenants with rights of survivorship, are the <br />owners of a residence located at 403 E. Hall, Grand Island, Hall County, Nebraska, more <br />particularly described as: <br />Lot 130 Buena Vista Addition to the City of Grand island, Hall County <br />Nebraska <br />The legal description referred to in this paragraph is set forth on Exhibit "B ", <br />attached hereto. <br />The Petitioner shall be awarded this real estate and home residence as her sole and <br />separate property, free and clear of any interest of the Respondent, and she shall pay and <br />hold the Respondent free and harmless from any and all liability for any loans, <br />encumbrances, - taxes and insurance due on said residence by making the payments as <br />they become due and payable. The Respondent shall, upon entry of the Decree of <br />Dissolution of Marriage, execute a Quitclaim Deed to the Petitioner releasing his interest <br />in said real estate. The Respondent agrees that in his failure to execute a Quitclaim Deed <br />to the Petitioner, that any Decree of Dissolution approving this Property Settlement <br />Agreement shall act as a conveyance to the Petitioner of all right, title and interest in said <br />real estate previously held by the Respondent to the Petitioner. The Petitioner shall be <br />responsible for paying the monthly payments on said real estate and any debt of said real <br />estate as the debt becomes due and payable. <br />9. RETIREMENT PLANS AND 401 K PLANS: The Petitioner shall receive as her <br />sole and separate property the 401 K plan presently issued in her name alone and <br />generated through her employment at ConAgra, Grand Island, Nebraska.
