4 201402417 5. DURABILITY. This power of attorney shall not be affected by any disability, incompetence, or incapacity which the principal may suffer at any future time or times, whether or not the same shall be adjudicated by any court, it being the principal's intent that the authorizations and powers granted herein shall remain exercisable notwithstanding any such subsequent occurrences. 6. RELIANCE. All persons dealing with an attorney in fact named herein or substituted hereunder may rely on a carbon, thermo- fax, Xerox or photostatic copy hereof and on a carbon, thereto -fax, Xerox or photostatic copy/ of such appointment of substitutes without requiring the production of the original instrument. Further, all persons dealing with any such attorney in fact may rely on his written statement to the effect that, to the best of his knowledge, the principal is still living and that the principal has not revoked this power of attorney. 7. GOVERNING LAW. This power of attorney shall be governed by the laws of the state of Colorado in all respects, including its validity, construction, interpretation and termination. 8. DISCLAIMER. My agent may disclaim, release, remove or abandon any property or interest therein or power relative thereto (including the power to alter, amend, revoke, or terminate) which for any reason and by any means I may now hold or to which I may hereafter become entitled, whether by retention, gift, or testate or intestate succession and whether passing to me or for my benefit, outright, in trust or otherwise, and may exercise any right or power I may have in the estate of another person, whether or not such other person is then living including, but not limited to, the right to claim an elective share in any estate or under any will. In the exercise of the powers conferred hereunder, my agent should act in a manner consistent with any estate planning actions which I may have taken or which my agent may have taken pursuant to other provisions of this Power, giving consideration to the effects, tax or otherwise, of any such disclaimer, release, abandonment or exercise upon persons interested in my estate and persons who would, but for such action, receive property which is affected by such action.
