the Grantee on behalf of itself, its successors and assigns, covenants and agrees that the Grantee <br />or the then record owner of the Property will be fully responsible for any investigation and /or <br />remediation of hazardous substances, pollutants or contaminants, or petroleum or petroleum <br />derivatives, to the extent that such investigation and /or remediation becomes necessary in <br />response to a violation of the land use restrictions. <br />3. Submissions <br />20140227 <br />Modification of Restrictions. Notice of Underground Storage Tanks /Aboveground Storage Tanks <br />The Grantee is hereby informed and does acknowledge that Underground Storage Tanks <br />and Aboveground Storage Tanks that contained gasoline, diesel fuel and heating oil, were <br />formerly located on the premises. All underground storage tanks and surrounding soil were <br />removed no later than 1993. The aboveground storage tanks were removed in 2002. <br />J. Notice of the Potential Presence of Munitions and Explosives of Concern <br />(MEC) <br />1. The Grantee is hereby notified that due to the former use of the Property as a <br />military installation, the Property may contain munitions and explosives of <br />concern (MEC). The term MEC means specific categories of military munitions <br />that may pose unique explosives safety risks and includes: (i) Unexploded <br />Ordnance (UXO), as defined in 10 U.S.C. § 101(e)(5); (ii) Discarded military <br />munitions (DMM), as defined in 10 U.S.C. § 2710(e)(2); or (iii) Munitions <br />constituents (e.g., TNT, ROX), as defined in 10 U.S.C. § 2710(e)(3), present in <br />high enough concentrations to pose an explosive hazard. <br />10 <br />
