This Permanent Flood Easement and Temporary Construction Easement Agreement is

<br />MIETH, as Trustee of the STUART W. MIETH TRUST, and CAROL M. MIETH, in her
<br />individual capacity, hereinafter collectively referred to as the "Grantor", and CENTRAL PLATTE

<br />WHEREAS, the Grantee seeks to obtain a permanent easement for occasional flooding or
<br />water retention and flow impediment from time to time, over and upon that real estate specifically
