agents with respect to the operation of the Water System or on the property when exercising rights <br />under this easement, except such claims as are caused by the negligence of GRANTOR. <br />SECTION SIX. TERMINATION OF EASEMENT <br />In the event of a failure of GRANTOR'S residential septic system that reasonably requires <br />placement of a septic tank or laterals in, under, along or upon the easement area, GRANTOR may <br />terminate the easement upon written notice provided to GRANTEE. Within a reasonable time following <br />GRANTEE'S receipt of notice of termination, GRANTEE shall cause said well to be decommissioned <br />and closed pursuant to applicable law, rules and regulations and shall cooperate with GRANTOR in <br />executing and recording a termination of GRANTEE'S easement interest conveyed hereby. Provided, <br />however, a failure of GRANTOR'S residential septic system shall not be considered an event that <br />reasonably requires placement of a septic tank or laterals in, under, along or upon the easement area if <br />the tank or laterals can be placed elsewhere upon the Property without requiring relocation the <br />GRANTOR'S potable water well. <br />SECTION SEVEN. BINDING EFFECT <br />The terms and conditions of this Agreement shall run with the land and be binding on <br />GRANTOR, and GRANTOR'S heirs, successors and assigns and upon GRANTEE and GRANTEE'S <br />successors and assigns. <br />The parties have executed this Easement Agreement the day and year first set forth above. <br />Daniel 5.
