<br /> 21. Hazardous Substances� As used �t� �his Se�tinn 21: (a� ''Flazardous Su�stances" are thflse su�astances
<br /> defined as toxic or hazardous �ubsta�►ces, pflllutants, ar wa�tes by En�ironmental Law and �he fo�low�ng
<br /> substances: gasaline, keros�ne, other �lammabie�r t�xic petroleum product�, t�xic pesticic�es and her�icides,
<br /> ►vo�atile solvents, ma�erials containin,� asbestos ar farmaidehyde, and radioaetiv� materia�s; �b�
<br /> "Enviror�me�ta� �aw" means federal �aws and laws Clf tih� �j�I`15C�1C�1Dri where the Prnperty is l�cated tha�
<br /> relate to health, safe�y or en�ironmental protec��c�n; �c) "��rvironme�ta� C'�eanup" includes any response
<br /> action, remedia� actron, or removal act�on, as defined in Environmenta� Law; and (d} an "Environrrae�atal
<br /> �'and�tion" means a condi�ion that can cause, �ontrihu�e to, or other�ise trigger an Env�ronmen�tal Cleanup.
<br /> Borrawer shall not cause or permi� the presence, use, disposal, storage, or r�lease af any Hazardous
<br /> Substances, or threaten to release any Hazardous Substances, on or in the Prop�rt�. Borrower shall not do,
<br /> nor a1�ow an�one eise to dv, anything affecting t�he Property �a� thar is in violatian af any En�ironmental
<br /> Law, (b} which creates an En�ironme�tal Condition, or �c� wh�ch, due ta the presence, u��, or release of a
<br /> Hazardous Su�stance, creates a cc�ndit�on that ad�ersely affe�ts the �a1ue of the Property. The preceding two
<br /> sentences shal� not apply to the presence, use, or storage on the Pr�per�ty of sma�i quantiri�� of Hazardous
<br /> Substan�es that are generally recogni�ed tc� be appropriate to normal resident�al use5 and to maintenance af
<br /> the Property �including, but not�in�ited t�, hazardous subs�ances in consumer praducts}.
<br /> Borrow�r sha�l prompt�y give Lender writ�en notice of(a}any investiga�ion, elaim, demand, }awsuit or ather
<br /> act�on by any go�ernmental or regu�atary agency or pri�a��par�y in�otving the Praper�y and any Hazardaus
<br /> Substance or Environmental La�v of which B�rrower has actual know�edge, �b� any En�irnnmenta�
<br /> �ondition, including bu� not limi�ed to, any sp�lling, leaking, discharge, re�eas�or thr�at of release Qf an�
<br /> Hazardous Substance, �nd �c)any can�iit�on c�used b� the pre�ence, use or re�ea.se af a Hazardous Substance
<br /> which ad�ersely affe�ts the �alue af t.�e Praperty. If Borrower learns, or is nvtified by any gaWernmen�al ar
<br /> regulatary author�ty, or any private party, that any r�ma�al or other remediatian af any Hazardous Substance
<br /> affecting the Pro�er�y is nec�ssary, Borrflv�rer shall promptly take all necessary remedia.I actions in
<br /> accordance vvith En�ironmenta� Lativ, N�thing herein sha�l create any obligati�n o� Lender for an
<br /> En�ironmental C�eanup.
<br /> Non-Unifvrm Co�enants. Borrower and I�ender co�enan�and agree as fol�ows:

<br /> Borrawer's breach of any ca�enant ar agreement in this Secur�ty Instrument (but not prior �o
<br /> acce��ration under Sect�an 18 unles� Ap�licable Law pravides vtherwise}. The natice sha�l sperify: (a�
<br /> the default; �b} the action required to �ure the default; �c� a date, nat les5 than 3U days from the dat�
<br /> the notice is gii�en to Barrower, by vvh�ch the default must be cured; and (d} that faiiure ta cure the
<br /> deFault on vr befare the date specit�ed in the natic� may result in acc�leration of the sums secured by
<br /> this Secur�i�y Instrument and sale of the Property. The nvtic� sha�l further inf�rm Barrvwer of th�
<br /> r�ght tv reinstate after acceleration and the right�o brin�a caurt action to assert the non-ex�stence of a
<br /> d�fault or any oth�r defense vf Borr�wer to acc�leraiian and sa�e. If #he default is nat �ured on vr
<br /> �efvre the date specif�ed in th� natic�, I�ender at its apt��n may require irnmediate payment �n full of
<br /> a�l sums seGur��hy this Security Instrument withaut further demand and may in�vke the p�wer o��al�
<br /> and any other rem�clies permitt�d by Applicable Law. Lender �hal� be entitled to callect a�l expenses
<br /> incurred in pursuing the remedies p�ro�ided in �his Sectivn 2�, in�luding, but not limited to, reasonable
<br /> att�rneys' fees and casts of titl�evidence.
