<br /> En�ironmen#al Laws. Trustvr au#ho�izes Lender and its agents tv enter upan the Praperty to make such
<br /> inspections and tesfs, a# Trustar's expense, as Lender may deem appropria�e to determine compliance af the
<br /> Property wi#h this section of the ❑eed of Trust. Any inspectians or�esfs made by Lender sha!! be for Lender's
<br /> purpases only and shall not be construed to create any responsibility ar liabi�ity an the part of Lender to Trustar or
<br /> #o any a#her person. The representations and war�anties contained herein are based on Trustor's due diligence in
<br /> in�estiga��ng the Prope�-ty for Hazardous Substan�es. Trustor hereby {1} releases and wai�es any€uture c�a�ms
<br /> against Lend�r for indemnity or contribu�ian in #he e�ent Trustor becomes liabfe for c�eanup or o#her costs under
<br /> any such laws; and t2} agrees ta indemnify,defend,and hold harmless Lender agains�any and all claims, Iosses,
<br /> liabilities,damagQs,penalties, and expenses which Len�ler may directly or indirectly sustain or suf�er resul#�ng�rom
<br /> a breach of this sectian vf fhe Dead nf Trust or as a consequence of any use, generafion, manufac#ure, storage,
<br /> disposal,release or threatened re�ease�ccurring prior to Trustor's ownership ar interest in the Proper�y,whether or
<br /> not the same was ar should have been knvwn tv Trustor. The provisinns of this section a€the Deed of Trust,
<br /> including the obligatian tv indemnify and defend,shall survi�e the payment of the indebtedness and the satisfactian
<br /> and recvn�eyance vf the lien of th�s Deed vf T�-ust and shall not be affected by Lender's acquisition of any interest
<br /> in#he Property,whether by fore��osur�or otheruvise.
<br /> Nuisance, YVaste. Trustor shall nat cause, conduct or permit any nuisance nvr commit, permi�, or suffer any
<br /> stripping of or waste an vr to the Property or any portion of the Property. Wi�haut limiting the generality o�#he
<br /> �oregoing, Trustor wi�l nvt remo�e, or grant to any other party the right to remo�e, any timber, minerals tinc�uding
<br /> vil and gas},cval,clay,scaria,sv�l,gra�el❑r rack produGts without Lender's prior written cansent.
<br /> Remo►ral of Jmpro�ements. Trustor shall nfl�demolish or remo�s any Imprv��ments f�om the Real Property without
<br /> Lender's prior written consen�. As a Gvndition to#he rema�al o�any�mpro�ements,Lender may requ��e Trustor to
<br /> make arrangements sa�isfactory to Lender to rep�ace such Impro�emen#s with Imprv�sments of a� least equal
<br /> �aiue.
<br /> Lender's R�ght#o Enter. Lender and Lender's agents and representati�es may enter upon the Rea� Property a�all
<br /> reasanabl� �'rmes to attend to L�nder's interes#s and to inspect the Rea� Property for purpases of Trus�or's
<br /> compliance with the terms and conditians of this Deed of Trust. -
<br /> Compliance with Go�ernmen#al Requirements. Trus#or shall promptly �omply wi#h all laws, ordinan�es, and
<br /> regulatians, now or hereafter in efFect, of a1l go�ernmental authorities app�icab�e ta the use vr occupancy of the
<br /> Property. Trustor may contes#in goad�ai�h any such law,v�dinance,or�-egulation and wi#hhald compliance during
<br /> any proceeding, including appropriate app�als, so long as Trusfor has notifred Lender in writing prior tv dving so
<br /> and so lang as,in Lender's so�e opinion, Lender's interests in the Praperty are nat jeapardized. Lender may require
<br /> Trustvr to post adequate sscuri#y ar a sur�ty band, reasanably satisfac#ory t�Lender,ta protect Lendsr's in#er�st.
<br /> Duty tv Protect. Trustor agrees n�i�her to abandon vr [ea�e unattended the Property. Trustor shall do all ather
<br /> ac�s, in additivn to those ac�s set forth abo�e in this section,which from�he character and use vf the Property are
<br /> reasonably necessary to protect and preserve th�Prvperty.
<br /> DUE�N SALE-C�NSENT BY LENDER. Lender may,at Lender's option,declare immediately due and payable a�l sums
<br /> secured by this Deed of Trust upon the sale or#ransfer,w�thaut Lender's prior written cvnsent, af al�or any part of the
<br /> Real Property, or any�nterest in the Rea� Praperty. A"sale or transfer"means the con�eyance of Real Prvperty vr any
<br /> right, title vr interest in fhe Rea! P�operty; whe�her legal, beneficial ar equitable; whether �olun�ary or in�oluntary;
<br /> whethe� by ou#righ� sale, deed, installment sale cantract, land �an�ract, contract fvr deed, leasehold interest with a
<br /> term grea#er than three�3}yaars, lease-option cantract, or by sale,assignment, vr transfer of any b�nefcial interest in
<br /> or tv any land trust holding title to the Real Property, vr by any o#her m��hod vf�on�eyance of an interest in'�h� Real
<br /> Properky. Hvwe�er, #his option shall no� be exercised by Lender if such exercise is prohibited by federal faw or by
<br /> Neb�aska Iaw.
<br /> TAXES AND LIENS. The following pro�isions relating to�he taxes and I�ens on the Property are part vf this Deed of
<br /> Trust:
<br /> Payment. Trustor shall pay when due�and in all e��nts prior�o de�inquency}a�l taxes,spec�al faxes,assessmen�s,
<br /> charges��ncluding water and sewer},fnes and impositions�e�ied agafnsf ar on account af the Property, and shall
<br /> pay when du�all claims for work dvne on or for services rendered or material furnished to the Praperty. Trustor
<br /> shall maintain the Propetty free of al�liens ha�ing priority o�er or equal to the interest of L�nder under this Deed of
<br /> Tr�ust, excep# �or �he lien of taxes and assessments not due, except for fhe Exis�ing Indebtedness referred �o
<br /> below,and except as atherw�se pro►►ided in this Deed o#Trust.
<br /> Right�a Cvntest. Trustor may withhv�d payment of any#ax, assessment,or claim in connectivn with a gaod faith
<br /> dispute o�er the obligatian to pay, s❑�ang as Lender`s interes#in#he Property is not jeapa�dized. If a lien arises or
<br /> is filed as a r�sult af nonpayment, Trus�or shalf wi#hin fifteen �'I5} days af�er the lien arises vr, if a �ien is filed,
<br /> within fifteen {�f5} days af�er Trus�or has notice af the fling, secure the d�scharge of the lien, ar i�requested by
<br /> Lend�r,deposit with Lender�ash or a su�ficien�corporate surety bvnd or other security sat�s�actory to Lender in an
<br /> arnaunt suffi�ient to discha�ge th�Fien plus any costs and attomeys'�ees, or other charges that cvuld accrue as a
<br /> result of a�a�-e�lasure or sale under the lien. In any cont�s�,Trustor shall de�end itse�f and Lender and sha��sa#isfy
<br /> any ad�erse�udgmenf befor�enforcement agains��he Property. Tn.istar sha�l name Lender as an additional vbligee
<br /> under any surety bond�urnished in the cantes�proceed�ngs.
<br /> E��denc� of Payment. Trustor shall upan demand furnish to Lender satisfac#ory e�idence of payment of the#axes
<br /> or assessments and shall authorize the apprapria�e go�ernmen#al affcial tv deliver to Lender at any time a written
<br /> statement af the taxes and asssssmenfs agains#the Property.
<br /> Nvtice af Construction. Trusfar shali nntify Lender at leasf fifteen {15}days before any work is cammenced, any
<br /> senrices are furnished,vr any maferials ar�suppf�ed tv the Property, if any mechanic's lien, ma#eria�men's fien, ❑r
<br /> other lien could be asserted on accvunt of the wvrk, services, ❑r materials and the cast exceeds $7,�D�.��.
<br /> Trustnr will upon reques�of Lender fumish to Lender ad�an�e assuranc�s satisfactory to Lender that Trus�or can
<br /> and will pay the cos#vf such impro�ements.
<br /> PR�PERTY DAMAGE lNSLlRANCE. The fol�ow�ng pro�isivns re�ating to insuring the Property are a part o#this Deed v€
