<br /> �1. HazardousSubstances.As used in�his Section 21: (a} "I-�azarc�ous,Su�.star�ce.s"are those substances
<br /> defined as toxi�or hazard�us substances,polluta.nts,or wastes by Environmenta.�Law and the following
<br /> substances: gaso�ine,kerosene,other flammable or�oxic petroleum praducts,toxic pesticides and h�rbic�des,
<br /> �o�at���solvents, materials canta.ining asbestos or formaldehyde, and radioactive materials; �b�
<br /> ".�nvirorc►raent�Z�,��v"means federal laws and lavvs of the jurisdic�ion where the Property �s located�hat
<br /> relate to health, safety or enviranmenta.l pratection; (c� "�r�viro��n�rctal Clecx►�u�"includes an�response
<br /> action, remedial action, or remova�a�tion, as defined in En�ironmental Law; and(d}an "Er�v�ror�me�tal
<br /> Corcditiort"means a condition that can cause,c�ntribu�e to, or�therwise�rigger an En�ironmen#a��leanup.
<br /> Borrower sha11 not cause�r permit the pr�sence,use,disposal, storage,or rel�ase of any Ha�ardaus
<br /> Substa.nces,or threaten to re�ease any I�a�ardous Substances,on or in the Proper�. Borr��ver sha11 not d�,
<br /> nar a11ow anyone else to do,anything affeCtrng the Froperty�a)that is in�iolation of any En�i.ronmental
<br /> Law, (b}�vhich creates an En�ironmental Condition,or(c}�hich,due to the presence,use,ar release of a
<br /> Hazardous Substance,creates a condition that adversely affects the value of the Property. The preceding�vo
<br /> sen�ences shal�not apply ta the presence,use,or storage on the Property of sma�l quantities of Hazardous
<br /> 5ubstances that are generally recognized to b�appropriate�o normal residential uses and to maintenance of
<br /> the Property(including,but not�imited to, hazardous subs�ances in cansumer products).
<br /> Borrower shall promp�iy give Lender writ�en notice of�a�any inve�tiga�ion,clairn,demand, lawsuit or other
<br /> action by any governmental or regul�.t�ry agency or private party in�ol�ing the Property and any Hazardous
<br /> Substa.nc�or En�ruonmen�a�Law of which Borrower has actual kn�tivledge, (b}any Environmenta.l
<br /> Cond��ioa, including but not limited to,any spxlling, leaking,discharge,release or threat af re�ease of any
<br /> Hazardous Substa.nce,and(c�any condition caused by th�presence,use or rel�ase of a Hazardaus Substance
<br /> v�hich ad�ersely affects the value of�he Pra�er�y. If Borro�er�earns,or is n��if ed by an}�gov�rnmental or
<br /> regulatory auth�rity,or aay private party,that any removai�r other remediatian of any Hazardous�ubstance
<br /> affecting the Praperty is necessary,Borrotiver sha11 promptly take a��necessary remedial actions in
<br /> accordance with En�ironmen�al Law.Nothing herein sha11 create any obligation on L�nder for an
<br /> Environrnental Cleanup.
<br /> Non-Un�fvrm Covenants.Borrower and Lender co�renant and agree as follows:
<br /> 22. Acceleration;Remedies.Lender shall g�ve notice t�B�rrower pri�r to accelerati�n following
<br /> Borrower's breach of any covenant or agreement�n�h�s Security Ins�rument�but n�t privr tv
<br /> acceleration under Section 18 unless Applicable Law provides otherwise}.The natice shall specify: �a}
<br /> the defa�.�t;�b}the act�io���equired to cure th�default;tc}a da�e,n�t less than 3�days fram the date
<br /> the nati�e is given to Borrvw�r,by whYch the default must be cured; and�d}that failure ta cure the
<br /> default au or befare the da#e specif ed in the natice may result in acceleration of the sums secured by
<br /> this Security Instrument and sale�f the Propert�.The noti�e shall further inform Borrower af�he
<br /> right t�reinstate after acceleration and�he right to bring a court action t��ssert the nan-�existence�f a
<br /> default or any other defense of Barro�ver to acceleratitin and sale.If�he defau�t�s nat cur�d vn or
<br /> befvre the date spec�fied in�he notice,Le�der at it��pt�o�may require immed�ate payment in full�f
<br /> all sums secured b�this Security Instrument withaut further demand and may invake the power of sale
<br /> and any vther remedies permitted by Applicabie Law.Lender shall be entitled tQ collect all expenses
<br /> incurred in pursuing the remedies provided in�his Section 22,including,but not limited to,reasonabie
