<br /> 21. Hazardou5 Substartces. As used in tt�is Seckion 21: (a) "Hazardaus Substarlces" are those snbstances
<br /> defined as toxic ar hazardaus substances, paltutants, or wastes 6y Environmental Law asad the fol�awing
<br /> substances: gasoline, kerosene, other flammahle or toxic petraleum products, toxic pesticides and�erbzcides,
<br /> va�atile solvents; materiais cantain'rng asbestos or formaldehyde, and. radiaactive rnaterials;. {b)
<br /> "Environmental Law" rneans federal laws and laws o� the jurisdiction where the Property is loca#ed tlaat
<br /> relate ta health, safety or environmental protection; (c} 'Err�v�ronrnental Cleanup" includes any response
<br /> action, rernedial action, or removal action, as defiiaed in Environmental Law; and (d) an "Enviro.nmer�tal
<br /> Condrtron"means a condition that can cause, contr�ibute to, or otherwise trigger an Environmental Cleanup.
<br /> Borrower shatl not cause or permit tihe presence, use, disposal, storage, or release of any Hazardous
<br /> Substances, or#hreate� to release any Hazardous Substan�ces, on or in the Property. Borrower shall not da,
<br /> nar allaw anyane else to do, anything a£�'ecting the Property (a) that is in violat�on of any Envirorunental
<br /> Law, (b} which creates an �nviror�ental Conditian, ar (c) wt�ich, due ro the presence, nse, or release of a
<br /> Hazardous Substance, creates a condition that adversely affects the value of the Property. Tk�e preceding two
<br /> sentences shall not appiy ta the presence, use, or starage an the Property af small quantities of Hazardous
<br /> Substanees that are generally recognized to be appropriate to normal residentiaI uses and to �aiz�tenance �€
<br /> the Property (inciuding, bat not Iimited to, hazazdous snbstances in cansumer praducts).
<br /> Borcower shall promptly give Lender written no�ice of{a) any investigation, claim, demand, Iawsuit or other
<br /> action by any governmental or regulator�agency or private party involving the Froperty and an�y Hazardous
<br /> Substanee or �nvironmentai Law of which Borrower has actual knowledge, {b} any Environmental
<br /> Condition, including bnt not limited to, any spilling, leaking, discharge, release or threat of release of any
<br /> Hazardous Substance, aud (c) any candition caused by tk�e presence, nse or release of a Hazardous Substance
<br /> which adversely affects the value of the Properky. If Borrawer learns, or is nodfied by any governmental ar
<br /> regulatary authority, or any p�ivate party, that any removal ar other rernediation of any Hazardoc�s Substance
<br /> affecting the Prpperty is necessary, Borrower shall prompdy take all necessary remedial actions in
<br /> accordance with Enviranmental Law. Nothing herein sha�l create any obligation on Lender for an
<br /> Environmentai Cleanup.
<br /> No�1-Unifor'm Co►►enar�tS. Borrower and Lender covenant and agree as follaws:
<br /> 22. ACCelet�tion; Remed�eS. Lender shall give notice ta Barrower prior to acceleration following
<br /> Borrawer's breach of any covenant or ag�reement in this Security Insirumetat (but not prior to
<br /> aceelerati.on under Section 18 unless Applicable Law provides otherwi.se). The natice shall specify: (a)
<br /> t�e default; {b)the actian zequired to cure the default; (c) a dat�, not less than 30 days from the date
<br /> the notice is given to Borrower, by which the d�:fau}t must be cured; and (d}tha# failure to cure t�e
<br /> default an ar before the date specified in the natice may result in accele�'ation of the sums secured by
<br /> this Security Instr�ment and sale crf the Progerty. The natice shall further inform Borrower �f the
<br /> right to reinstate af�cr accelera#ion and the riglat to brimg a court action to assert the no�n-existence of a
<br /> default or any other defense of Borrowear to acceleration and sale. If the default is not cured on or
<br /> before the date specified in the notxc�, Lender at its option xnay require immediate payment ffi full af
<br /> all sums secured by this Security Instrumen�wi�hont fiu�h�r demand an.d may invoke the power of sale
<br /> and any other ze:meciies permitted by Apglicabl� Law. I,�nder shall be enti�led to collect all expenses
