<br /> other action by any governmental or regulatory agericy or private party involving the Property and any

<br /> is notified by eny governmental or regulatory authority, that any removal or other remediation of any

<br /> As iued in this paragraph 16, "Hezardous Substances"are those substances defined as toxic or hezardous
<br /> suhstances by Environmental Law and tho following eubstances: gasuline,kerosene, other flammabl�or tozic
<br /> petroleum produc�9, toxic pesticides and herbicidcs, volatile solvents, materials containing asbestos or
<br /> formaldehyde,and radioactive meterials. As us�d in this paragraph 16, "Environmentel Law" means tederel
<br /> laws and lew�of tiie jurisdiction where the Property is lceated that relate to health, satety or cnvironmentel
<br /> protection.

<br /> hereby directs each tenent of the Property to pey the rents to Lendor or I�ender's agenu. However, prior to
<br /> Lender's notice to Borrower o{Aocrower's breach of eny cov�nant or agreement in the Security lnstrument,
<br /> Iiorrower shall collect and receive all rents and revenues of the Property as trustee for the benefit of Lender
<br /> and Borrawer. This assignment of rents constitutrs an absolute assignment and not an aesignment tor
<br /> additional security only.
<br /> If Lender givas notice of breach to Borrower: (a) all renta received by Borrower shall be held by
<br /> Borrower as trustee for benefit of Lender only,to be e�plied to tt�e sums securcd by the Security Instrument;
<br /> (b) I,ender shall be entitled to collect and receive all of the rents ot the Property; and(c)oach tenant of the
<br /> Property shall pay all renta d�u and unpaid to Lender or Lcnder's agcnt on Lender's written demand to the
<br /> tenant.
<br /> Dorrower has not exxuted any prior assignment of the renta and has not and will not per orm any ect
<br /> that would prevent Lender from exercising its rights under this peragraph 17.
<br /> Lender shall not be required to enter upon,take cantrol of or mnintain the Property before or aftcr giving
<br /> notice of breaeh to Bo�rower.However,Lendec or a judicially appointed receiver may do so at any time there
<br /> is s breach.Any application of rents shall not cure or waive any defauli or invalidate any other right or rernaly
<br /> of Lender. T'his assignment of rents of the Property shall terminate when the debt sa;ured by the Sxurity
<br /> Instrumcntis paid in full.
