Subordinate Lien Rider <br />(Farmer Mac 1 Lien & Farmer Mac Ag Equity 2 Lien) <br />Ag Land <br />Hall County, NE <br />201400935 <br />This Rider is made this February 18, 2014, and is incorporated into and shall be deemed to amend and <br />supplement the Mortgage, Deed of Trust, or Security Deed (the "Security Instrument ") of the same date given by <br />the undersigned (the "Borrower ") to secure Borrower's Note (the "Note ") to First Dakota National Bank (the <br />"Lender ") of the same date and covering the property described in the Security Instrument and located at: <br />1. SUBORDINATE LIEN <br />The lien created by this Security Instrument ( "Farmer Mac Ag Equity 2 Lien ") will be subordinate to the <br />lien securing payment of two notes, and any renewals, extensions, and modifications thereof, in the original <br />principal amount of Six Hundred Sixty Two Thousand and 00 /100 DOLLARS ($662,000.00), which is dated <br />July 18, 2013 executed by Patrick J McGuire and Patrick J McGuire Revocable Living Trust dated August 9, <br />2007, payable to the order of US Bank National Association as Custodian/Trustee for Federal Agricultural <br />Mortgage Corporation Programs, and more fully described in a Security Instrument recorded in Instrument No. <br />201305814 of the real property records of Hall County, NE ( "Farmer Mac 1st Lien "). The combined original <br />principal loan balances for the three loans equal Seven Hundred Thirty Seven Thousand and 00 /100 DOLLARS <br />($737,000.00). If default occurs in payment of any part of principal or interest of that Farmer Mac 1st Lien note or <br />in observance of any covenants of the security instrument securing it, the entire debt secured by this Farmer Mac <br />Ag Equity 2 Lien will immediately become payable at the option of Lender. <br />If Grantor fails to pay any part of principal or interest secured by a prior lien or liens on the Property <br />when it becomes payable or defaults on any prior lien instrument, the entire debt secured by this deed of trust will <br />immediately become payable at the option of Lender. <br />2. CONFLICTS <br />If any term or provision of this Rider shall be in conflict with any term or provision of the Note or Security <br />Instrument, the term or provision of this Rider shall control. Any provisions of this Rider adjudged to be invalid <br />shall be deemed amended from it, with the remainder of the provisions to be in full force and effect.
