This assignment of Rents constitu[es an absolute assignment and not <br /> an assignment for additional securlty only. <br /> If I.endcr gives notice of brcach to Borrower: (i)all Rents received by Borrower shall be hold by Borrower <br /> as trustee for the benefit of Lender only,to be appli�d to the sums secured by the Security Instrument; (ii)I.ender <br /> shall be entitled to collect and receive all of the Rents af the Propeny;(iii)Borrower agras that each tenant of thc <br /> Propeny shall pay all Rents due and unpaid to Lcnder or Lender's agents upon Lendcr's written demand to the <br /> tenant; (iv)unless applicable law provides othcrwise,all Rents callected by Lcnder or Lendcr's agents shall bc <br /> applied�rst to the costs of taking control of and managing the Propeny and collecting the Rcnts, includiug, but <br /> not limited to, attomeys' fees, receiver's fees, premiums on receiver's twnds, repair and maintenance costs, <br /> insurance premiums, taxes, assessments and other chuges on the Property, and then to the sun�s securcd by the <br /> Security Jnstrument;(v)L,ender, Lender's agents or any judicially appointed receiver shall be liable to account for <br /> only those Rents actually received; and (vi) Lender shall be entltlui to have a receiver appointed to take <br /> possession of and manage the Property and collect the Rents and profits derivcd from the Property without any <br /> showing as to the inedequacy of the Property as security. <br /> If the Rants of the Propeny are not suffcient to cover the costs of taking control of and managing the <br /> Property and of collxting thc Rents any funds expcndal by Lender for such purposes shall become indcbtedness <br /> of Borr�wer to Lender secured by tha Security lnstrument pursuant to Uniform Covenant 7. <br /> Bortower represents and wanants that Borrowcrhas not exxuted any prtor assignment o�tne Kents anq nas <br /> not and wiil not pedorm any act that wauld prevent Lender from cxercising its rights under this paragraph. <br /> l.ender, or Lender's agents or a judicially appointec! receiver, sl�all not be required to enter upon, take <br /> coiitrol of or maintain the Propeny before or after giving notice of default to Bonower, However, Lender, or <br /> Lender's agents or a judicially appointed receiver,moy do so ac any time whon a default occurs. Any application <br /> of Rents shall not cure or waive any default or invalidate any other right or remedy of Lender. This assignment of <br /> Rents of the Propeny shall terminate when all the surm secured by the Security Instrurnent are paid in full. <br /> I. CRUSS-DEFAUI.T PROVICION.
