A RESOLUTION APPROVING THE RELEASE OF A SPECIFIC CONSERVATION EASEMENT WHEREAS, on May 18, 1982, Platte River Whooping Crane Maintenance Trust, Inc., a Nebraska non - profit corporation (hereinafter "Crane Trust ") obtained an Easement Grant from Binfield Corporation and which was recorded in the Register of Deeds Office, Hall County, Nebraska, at Document #82- 002833 (hereinafter "Easement Grant ") and that such Easement Grant is a conservation or preservation easement as set out in Section 76 -2,112 of the Nebraska Revised Statutes; and WHEREAS, on December 30, 2010, Platte River Recovery Implementation Foundation, a Nebraska non -profit corporation, Trustee (hereinafter "PRRIF ") purchased the real estate from "Crane Trust" subject to the "Easement Grant" from Binfield Corporation; and WHEREAS, on April 1, 2013, Crane Trust and PRRIF executed an agreement in which "Crane Trust" released and terminated the "Easement Grant"; and WHEREAS, PRRIF has applied to the Hall County Board of Supervisors for approval of the release and termination as provided in Section 76 -2,113 of the Nebraska Revised Statutes; and WHEREAS, the Hall County Board of Supervisors, having considered the conservation easement and application for its release, fmds that the release of said conservation easement is not against the public interest and that the intended use of said land by PRRIF appears to be similar and consistent with the terms and conditions of the conservation easement heretofore requested to be released. NOW, THEREFORE, BE IT RESOLVED that the release of the Easement Grant identified as Document #82- 002833 of the real estate records of the Hall County Register of Deeds, a copy of which is attached hereto and by this reference made a part hereof, is hereby approved and allowed.
