<br /> Aorrower absolutely and unconditionally assigns and transfers to l.ender all thc rents and revenues("Rents")of
<br /> the Propeny, regardlcss of to whom the Rents of thc Propeny arc payable. Borrowcr authorizcs Lender or
<br /> L.ender's agents to collect the Rents,and agrees that each tenant of the Propeny shall pay the Rents[o l.ender or
<br /> I.euder's agents. However,Borrower shall nctive the Rents until (i)L.ender has given Borrower notice of default
<br /> pursuant to paragraph 21 of the Security Instrument and(ii)l.ender has givcn notice to the tenant(s)that the Rcnts
<br /> arc to bc paid to Lender or L,cnder's agent. This assignment of Rcn�s constitutcs an absolutc aasignmcnt and not
<br /> an assignment for additional security only.
<br /> If Lendcr gives noticc of breach to Borrower: (I)all Rents reaivcd by Borrower shall be held by Aorrower
<br /> as trustec for the benefit of Lcnder only,to be appUed to the sums aecured by the 5ecurity InstNment; (ii)Lcnder
<br /> shaU be entitled to callect and receive all of th�Rents of the Property; (liq Borrower agrees that each tenant of the
<br /> Property shall pay all Rents due and unpaid to l.ender or Lender's agants Upon I.onder's writton decnand to the
<br /> [enant; (iv)unless applicable law provides otherwise, all Rents collected by Lender or Lender's agents sha11 be
<br /> applied first to the costs of taking control of and m�naging the Property and collceting the Rent�s,including, but
<br /> not limited to, attameys' fees, receiver's fees, premiums on receiver's bonds, repair and maintenance costs,
<br /> insurance premiums, taxes, assessments and other charges on the Propeny, and then to the sums secured by the
<br /> Security Instrument; (v)Lender,Leuder's agents or any judicially appointed receiver shall be liable to account for
<br /> only those Rents actually received; and (vi) [.ender shall be enti[led to have a receiver appointed ta take
<br /> possession of and manage the Property ;u�d collect the Rents and profits derived from the Propeny without any
<br /> showing as to the inadequxy of the Property as security.
<br /> If tho Rents of the Propeny are not sufficient to cover the costs of taking control of and managing the
<br /> Property and of collecting the Rents any funds eapendcd by Lender for such purposes shall becorne indobtedness
<br /> of Bonower to I.ender secured by the Security Instrument pursuant to Uniform Covenant 7.
<br /> Bonower r�presents and warrants that Borrower has not cxecuted any prior assignment of the Kents and has
<br /> aot and will not perform any act that would prevent Lender from exercising its ri�hts under this paraRraph.
<br /> L.eader, or l.ender's agents or a judicially appointed receiver, sh�ll not be required to enter upon, take
<br /> control of or maintain the Propeny before or after giving notice of default to Borrower. However. l.ender, or
<br /> Lender's agents or a judicially appointed receiver, may do so at any time when a default occuro. Any application
<br /> of Rents shall not cure or waive any default or invalidate any other right or remedy of L.ender.This assignment of
<br /> Rcnts of the Property shall terminate when all thc sums secured by the Security Instrument are paid ln full.
<br /> I. CROSS-DEFAULT PROVISION. Bonower's dcfault or breach undar any note or agreement in which
<br /> Ixnder has an interest shafl be a breach under the Sceurity Instmment and L.ender may invoka any of the recnedies
<br /> permittal by the Security Ins[rument.
