201400400 <br />In the event that this Security Instrument is foreclosed as a mortgage and the <br />Mortgaged Property or any part thereof sold at a foreclosure sale, the purchaser may, during any <br />redemption period allowed, make such repairs or alteration on any such property as may be <br />reasonably necessary for the proper operation, care, preservation, protection and insuring thereof. <br />Any sums so paid together with interest thereon from the time of such expenditure at the Default <br />Rate shall be added to, and become a part of, the amount required to be paid for redemption from <br />such sale. <br />Borrower agrees that if an Event of Default occurs and reinstatement is claimed <br />by Borrower under the provisions of any law permitting reinstatement upon payment of all sums <br />then due, Lender shall designate an attorney or other professional help for the assistance of the <br />Deed of Trust Trustee and the cost and fees of any such attorney or professional help together <br />with all other expenses incurred as a result of the Event of Default and foreclosure proceedings, <br />shall be deemed Deed of Trust Trustee's costs and shall be paid by Borrower directly to Lender <br />as a condition precedent to the reinstatement. <br />If two or more persons be designated as Deed of Trust Trustee herein, any or all <br />powers granted herein to Deed of Trust Trustee may be exercised by any of such persons, if the <br />other person or persons is unable, for any reason, to act, and any recital of such inability in any <br />instrument executed by any of such persons shall be conclusive against Borrower, its heirs and <br />assigns. <br />In the event of any non judicial Security Instrument foreclosure by Deed of Trust <br />Trustee hereunder, Borrower requests that a copy of any notice of default executed by Deed of <br />Trust Trustee hereunder be mailed to Borrower at its address hereinbefore set forth. <br />Lender may at any time and from time to time, by an instrument in writing served <br />upon the Deed of Trust Trustee, substitute a successor or successors to any deed of trust trustee <br />named herein or acting hereunder, which instrument, executed and acknowledged by Lender and <br />recorded in the office of the recorder of the recording district where the Premises are situated, <br />shall be conclusive proof of proper substitution of such successor trustee or trustees, who shall, <br />without conveyance from the predecessor trustee, succeed to all its title, estate, rights, powers <br />and duties. Said instrument shall contain the names of Borrower, the original deed of trust <br />trustee and Lender, the book and page where this Security Instrument is recorded, and the name <br />and address of the new deed of trust trustee. <br />**** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** <br />FOR MORTGAGED PROPERTY LOCATED IN DELAWARE <br />1. Paragraph 7(a) is hereby amended to add the following sentence at the beginning of the <br />paragraph: <br />This Security Instrument is intended to assign rents and leases pursuant to 25 Del. C. § 2121. <br />2. The following new subsection 25(g) is hereby added to this Security Instrument as <br />follows: <br />
