201400400 <br />replacements and improvements now or hereafter located thereon (the "Improvements ") for the <br />benefit of Lender;" <br />3. The last sentence of paragraph 18 of this Security Instrument is amended and restated in <br />its entirety as follows: "Borrower shall hold harmless and indemnify Lender, its successors and <br />assigns, for, from and against any liability incurred by reason of the imposition of any tax on the <br />making and recoding of this Security Instrument." <br />4. The last sentence of both subsections 19(c)(iii)(E) and 19(d)(iii)(E) shall be amended and <br />restated in each case in its entirety as follows: "Borrower hereby indemnifies Lender for, from <br />and against any such taxes." <br />5. Subsections 25(a)(ii), 25(a)(iii) 25(a)(iv)., 25(c), and 25(d) are hereby intentionally <br />deleted from this Security Instrument. <br />6. The following new subsections 25(g). 25(h) and 25(i) are hereby added to this Security <br />Instrument: <br />"(g) With respect to all or any part of the Premises, Lender may invoke the <br />power of sale, and direct the Deed of Trust Trustee to sell the Premises in accordance with and to <br />the full extent provided by applicable law. Borrower acknowledges that the power of sale herein <br />granted may be exercised by Lender without prior judicial hearing. Deed of Trust Trustee shall <br />deliver to the purchaser at such sale a Deed of Trust Trustee's deed conveying the Premises so <br />sold without any covenant or warranty, express or implied. Lender shall be entitled to collect <br />from Borrower all costs and expenses incurred in pursuing the remedies set forth in this Section <br />25, including but not limited to attorneys' fees and costs of environmental reports, appraisals, <br />documentary evidence, abstracts and title reports. <br />(h) With respect to all or any part of the Premises, Lender shall have the right <br />to foreclose by judicial foreclosure in accordance with and to the full extent provided by <br />applicable law. <br />(i) Lender at Lender's option may from time to time appoint additional or <br />replacement deed of trust trustees and may remove one or more deed of trust trustee, from time <br />to time, without the consent of or notice to Borrower, by an instrument recorded in the county in <br />which this Security Instrument is recorded. Without conveyance of the Premises, the successor <br />deed of trust trustee shall succeed to all the title, power and duties conferred upon the Deed of <br />Trust Trustee herein and by applicable law. Any Deed of Trust Trustee, individually, may <br />exercise all powers granted to the Deed of Trust Trustees collectively, without the necessity of <br />the joinder of the other Deed of Trust Trustees." <br />7. The eleventh sentence of Paragraph 27 of this Security Agreement is amended and <br />restated in its entirety as follows: <br />`Borrower hereby authorizes Lender to file financing statements, <br />continuation statements and financing statement amendments in <br />such form as Lender may require to perfect or continue the <br />- 74 - <br />
