<br />� 19. Financial Statements. Within sixty (60) days of the close of each calendar year, ��;-__
<br /> r� Trustor shall furnish Beneficiary� at Trustor's expense,all in a form satisfactory to Beneficiary and - _
<br />'- � certified by Trustor or guazantors�as the case may be,with(a)annual statement of operations of
<br /> • the Property, stating that such annual statement presents fairly the financial condition af the =
<br /> � property being reported upon and has been prepared in acc.ordance with soua�d accounting principles
<br />-� . f conslstently applied, (b)the financial statement for any tenants in whom Trustor has a controlling _
<br />� interest,and(c)Trustor's financial statement, if Trustor is not an individual. 'The azmual operating :
<br /> � statement shall include an annual rent schedule, and a schedule of gross receipts of each tenant wlio
<br /> is obligated to pay additional rent based on a percentage of gross receipts. _
<br /> � � 20. Prepaynaent Charges. Prepayfnent charges will be imposed, as specified in the
<br /> Note, w the extent permitted by law, whether the prepayrnent is(a) voluntary, involuntary, or by
<br /> operation of law, (b) in connection with a default in performance of the payment obligadons or any
<br /> other obligations under the Note or under any instrument securing the Note, or (c) required by
<br /> i . Iiene�ciary as provided hercin in connection with a transfer or contract to transfer the Trust
<br /> Property, provided that no prepayment charges shall be added to sums prepaid with casualty
<br />_ insurance proceeds or condemnation awards, or when the Note is grepaid within ninety(90)days
<br /> of its maturity date.
<br /> - 21. N���e���?_�*���'to Cure. Notwithstanding any other provision of this Deed
<br /> i, '� of Trust,Beneficiary shall not accelerate the sums secured hereby because of a nonmonetary default
<br />,��-��:•�� � (defvned below) by Trustor unless Trustor fails to cure the default within fifteen (15) days of the
<br /> earlier of the date on which Beneficiary mails or delivers written notice of the default to Trustor.
<br />' For purposes of this Deed of Trust,the term "nonmonetary default" means a failure by Truswr or
<br /> ' any other person or entity to perform any obligation contained in the Note or any otfner Loan
<br /> � � dceument,other than the obligat�on to make payments provided for in the Note or any other Loan
<br /> � �� - document. If a nonmonetary default is eapable of being cured and the cure cannot reasonably be
<br />;;`�;�-.'�,�:: completed within the fifteen(15)day cure period,the cure period shall be extended up to sixty(60)
<br />�` •;r;�' ' days so long as Truswr has commenced action to care within the fifteen(15)day cure period,and
