( "MERS "), a Corporation whose address is PO Box 2026 Flint, MI <br />48501 -2026 and Wells Fargo, a(n) Corporation, whose address is 304 W 3rd Street, Gran ebraska <br />68801 ( "Grantee "), by the undersigned. <br />Pursuant to the terms of an agreement dated April 11, 2012 (the "?il� `�" >t�" e K ". a•vances of <br />credit. <br />Funds advanced under the terms of the Agreement are secured by a ce eed of trust given to Grantee, dated <br />April 11, 2012, recorded on April 18, 2012, ; as i n s t 2 01 2 0 3 01 0 in records of Register of Deeds <br />of Hall County, State of Nebraska (the "Deed of Trust "), under the terms of which Grantee was granted a security <br />interest in the following described real property located in Hall County, Nebraska (the "Property"): <br />The Deed of Trust provides that future advances of credit made under the terms of the Agreement shall be secured <br />by the Deed of Trust, up to a maximum principal indebtedness of $193,819.00, plus accrued interest, any <br />protective advances made by Grantee to protect Grantee's interest in the Property, and other charges. <br />The undersigned desires to obtain from Union Bank & Trust Company, a(n) Commercial Bank, whose address <br />is 2008 North Webb Road, Grand Island, Nebraska 68803 ( "Lender "), a loan in the amount of $67,207.70 (the <br />"Loan"). Lender is unwilling to accommodate this request for said Loan unless Lender obtains a deed of trust on <br />the Property (the "Subordinate Deed of Trust ") and, as an additional condition, Lender requires that any future <br />advances that Grantee may make under the terms of the Agreement secured by the Deed of Trust be limited and <br />restricted as set forth herein. <br />In order to satisfy Lender's conditions for obtaining the Loan, it is the undersigned's express intent to limit, <br />pursuant to §76- 238.01, Nebraska Statutes, the ability to obtain future advances under the terms of the above - <br />described Agreement and Deed of Trust. <br />NOTICE IS HEREBY GIVEN TO GRANTEE, pursuant to §76- 238.01, Nebraska Statutes, that the above - <br />described Deed of Trust shall secure an amount not to exceed the amount actually advanced and outstanding as of <br />© 2004 -2011 Compliance Systems, Inc. 50B6 -CAE2 - 2010L1.15.148 <br />Notice of Limitation On Future Advances - DL2031 Page 1 of 2 www.compliancesystems.com <br />
