<br /> H. ASSIGNMENT OF RENTS; APPOINTMENT OF RECEIVER; L.ENU�;R IN YOSSl�:SSION, `
<br /> Bonower absolutely and unconditionally asaigns and tranafers to Lender all the rente and revenues("Rents") of
<br /> �hc Property, regardless of to whom the Rents of the Property are payable. Borcower authorius Laider or
<br /> Lcnder's agente to collxt the Rents, and agras that each tenant of the Property shall pay the Rents ta I.eiider ur
<br /> I.ender's agents. However, Bonower shall ra;elve the Rents until(i)Lender has given Bonower n�tice of default
<br /> pursuant to paragraph 21 of the Sscurity xnstrumant and(ii)Lender ha+given notice to the tenant(s)that the Renta
<br /> are to be paid to �tnder or Lender's agent.This assignment of Rent�constitutes an absolute assignment and noc
<br /> an assignment for additional security only.
<br /> If Lender gives notice of breach to Sonower: (i)all Rents received by Borrower sh�U be held by Bot7ower
<br /> as tmst�e for the henefit of Lender only,to bo applial to the su:ns secural by the Security Instrument; (ii) Lender
<br /> chall be entitled to collect and reccive ai!ef t}:.,Rents of the Property;(iii)Borrowar agras that each tenan[of�he
<br /> E'ropezty shall pay all Rents due and unpaid to Lender or I.ender'a agents upon Lender's written decnand ta the
<br /> tenant; (iv) unless applicable law provides otherwise, all Rents collxtal by l.ender or I.ender's agente ahall be
<br /> applied first to the costs of taking control of and managing the Property and collxting the Rents, Including, but
<br /> not llm3ted to, attorneys' fees, receiver's fas, premiums on receiver's bonde, repair and maintenance costs,
<br /> insurance premiums, ttues,assessments and other charges on the Property, and then to the sumc securod by tho
<br /> Secuiity lnattument; (v)Lender,L.�nder's agenta or any judicially dppointed receiver shall be liable to accouat for
<br /> only those Rents actually r�coived; and (vi) Lender shall be entitled to have a receiver appointed to take
<br /> posseasion of�nd manage the Property and collecs the Rents and profits derived from the Propecty without any
<br /> showiag u to�►e inAdequacy of the Property sis security.
<br /> If the Rents of the Property aze not sufficient to cover the costs of taking control of and man�ging the
<br /> Property and of collecting the Rents any funds expended by Lender for such pu�ses ehall become indebtedness
<br /> o�f Borrower to L.eader secured by the 5xurity Instrument pursuant to Uniform Covenant i.
<br /> Bonower rep�eaents and warrant9 that Bonower has nat exxuted any prior aSSignment of the R�nts and l�as
<br /> not and will not perform any act that would prevent Leader from exercising its d6hts under this pu�graph.
<br /> I..ender,or Lender's agents or a judici�lly appointod receiver, shall not be required to enter upon, take
