<br /> 6 . Eminent Domain. Lender is hereby asaigned all
<br /> • � compensatian, Awards, damagea aria other payments or relief ���
<br /> �r4, (hereinafter "Pxoceeds") in cannection with condemnaL-ion or otlier —
<br /> �,,,N,,� taking af the Property or part thereof, or for. conveyance i.n lieu
<br /> of condemnation. I,ender shall be entitled, at i�a option, to
<br /> commence, appear in and prosecute in its own name any action or —
<br /> proceedings, and shall also be entitled to make any compromise or
<br /> ': settlement in connection c�rith auch taking or damaqe. In the _
<br /> ; event any portion of the Property is so taken or damaged, Lender
<br /> shall have the option, in its sole and abaolute discretion, to
<br /> .' apply all such Proceeds, after d�ducting therefrom all costs and
<br /> ' expensea incurred by it in aonnaction with auch Proceeds, upon
<br /> any fndebtedness secured hereby and in such order as Lender may
<br /> �� determine, or to apply all suc h Proceeds, af�er such dec�uctions,
<br /> �. to the res toration of the Prop erty upon such cand3.tions as Lender �-
<br /> �, may determ3.ne. Any applicatio n of Proceeds to indebtedness shall
<br /> not exL-end or postpone the due date of any paymen�s under the
<br /> , ��' Note, or cure any default ther eunder or hereunder.
<br /> 7. Performance by I,enaer. In the event of Borrower' s
<br /> � f.ailure to perform any of the covenants herein or make any pay-
<br /> � ments requ ired hereby, or if a ny act is taken or legal praceeding
<br /> � commenced which materially a�feets Lender's interest in the
<br /> � Property, Lender may in its own discretion, but without obliga-
<br /> se. i�ion to do so, and without notice to or demand upon Borrower► and
<br /> � without releasing Horrower trom any obliyaLio�i, do any act �.:•hicYs .
<br /> the Horrower has agreed but fails to do and may also do any other
<br /> ac� it deer.is necessary to protect the security hereof. Borrower
<br /> sha11, immediately upon demand therefor by Lender, pay to Lender
<br /> all costs and expenses incurred ana sums expended by Lender in
<br /> connection with the exercise by Lender of the foregoing rights,
<br /> together with interest thereon at the default rate provided in
<br /> '� the Note, which shall be added to the—inde5tedness secured
<br /> � hereby. Lender shall not incur any liability because of anything
<br /> it may do or omit to do hereunder.
<br /> 8. Hazardous Mate ria].s. Borrower ahall keep the
<br /> ` Property in compl ance with any and all federal, state and local
<br /> �� laws, ordinancea and regulati ons rela�ing to industrial hygiene
<br /> � or to environmental condition s on, under or about the Property,
<br /> inaluding, but not ].imited to , soil and groundwater conditions.
<br />� �� Trustor shall not use, generate, manufacture, si:ore or dispose of -
<br /> ; on, �znder or abou� the Property or transport to or from the —
<br />- ' � Property any flammable explos�.ves, radioac�ive materials, hazardous
<br /> - wastes, taxic substancea or r elated materials, including, without =
<br /> ' limitation, any substances de fined as or included in the defini- ---
<br /> tian of "hazardous substances", "hazardous was�es" , "hazardous _
<br /> � materials" or "toxic substan ces" under any applicable laws, �
<br /> � ordinances or regulations (collectively referred to hereinafter �
<br /> as "Hazardous Materials") . Sorrower hereby warrants and repre- �
<br /> sents to Lender that there are no Hazardous Materials on or under � .
<br /> the Proper�y. Borrower hereby agrees to indemnify and hold
<br /> harmless Lender, i�s directors, officers, empJ.oyees and agents,
<br /> and any successors to Lender' s interest, from and against any and
<br /> �i all claims, damages and liabil.ities arising in connect3.on with
<br /> the prese nce, use, storage, d isposal or transport of any Hazardous
<br /> Ma�erials on, under, from or about the Property, including► with-
<br /> out Limitatiori, (a) all damages directly or indirectly arising
<br /> out of the use, generation, etorage or disposal of Hazardous
