January 9, 2017 <br />AFFIDAVIT <br />Return to: Skalka & Baack Law Firm, L.L.C., PO Box 907, Hastings, NE 68902 -0907 <br />This Affidavit is made based on Affiant's personal knowledge. <br />Further Affiant sayeth not. <br />DATED this /f 1 ` day of e Le.iice , 2013. <br />Jessie M. Casteel, Affiant, being first duly sworn upon oath, deposes and says that <br />Robert H. Casteel (hereinafter referred to as "Decedent "), died on March 20, 1990, being at said <br />time a resident of Hall County, Nebraska; that no proceedings to administer or probate <br />Decedent's estate have been had in the State of Nebraska or elsewhere; that Decedent at the <br />time of Decedent's death was the owner, together with Jessie M. Casteel (hereinafter referred to <br />as "Decedent's Surviving Spouse "), of the following described real estate, to wit: <br />Lot Three (3) in Island Acres subdivision No. 10, in the City of Grand Island, Hall <br />County, Nebraska. <br />Affiant, further states that Decedent was married to Decedent's Surviving Spouse, Jessie <br />M. Casteel, and remained married to Decedent's Surviving Spouse at the time of Decedent's <br />death. <br />As a result of Decedent's death, Decedent's Surviving Spouse became the sole owner of <br />the above described real estate as the surviving joint tenant. Pursuant to NEB. REV. STAT. § 77- <br />2003 et. seq., the above described real estate is not subject to Nebraska Inheritance Tax as <br />Decedent's Surviving Spouse became the owner of said real estate as the surviving joint tenant. <br />Affiant further states that Decedent's entire gross estate was transferred to Decedent's <br />Surviving Spouse as a surviving joint tenant or otherwise and, as such, all transfers qualified for <br />the unlimited marital deduction for United States Estate Tax Purposes.
