WHEREAS, Declarant is the owner of the real property located in the County of Hall, Nebraska, and further described on Exhibit "A" attached hereto (hereinafter the "Property "), which is comprised of the Residential Lots, the Cul-de -sac Lots and and the Detention Facility Lot (each, as hereinafter defined); and WHEREAS, Declarant desires to provide for preservation and enhancement of the property, values, amenities, and opportunities on a residential subdivision in the Property and for maintenance of the property and improvements thereon, and to this end desires to subject the Property and the improvements on the Lots therein to the covenants, restriction, easements, charges and liens hereinafter set forth, each and all of which is and are for the benefit of said property, and each owner thereof. NOW, THEREFORE, Declarant hereby declares that the Property shall be held, sold and conveyed subject to the following easements, restrictions, covenants and conditions, all of which are for the purpose of enhancing and protecting the value, desirability, and attractiveness of the Property. These easements, covenants, restrictions and conditions shall run with the land and shall be binding on all parties having or acquiring any right, title or interest in the described property or any part thereof, their heirs, successors or assigns and shall inure to the benefit of each owner thereof. 1.1 "Association" shall mean and refer to The Villas at Stolley Park Owners Association, Inc., a Nebraska non-profit corporation.
