12.10 Gender and Number. 12.11 Captions and Titles. 201309222 Wherever the context of this Declaration so requires, words used in the masculine gender shall include the feminine and neuter genders; words used in the neuter gender shall include the masculine and feminine genders; words in the singular shall include the plural; and words in the plural shall include the singular. All captions, titles, or headings of the Articles and Sections in this Declaration are for the purpose of reference and convenience only and are not to be deemed to limit, modify, or otherwise affect any of the provisions hereof or to be used in determining the intent of context thereof. 12.12 Initial Declaration Superseded. This Declaration shall supersede the Initial Declaration in its entirety. Upon the Recording of this Declaration, the Initial Declaration shall be of no further force or effect. 12.13 Certification. The Association certifies that this Declaration has been approved as required by the Declarant. ARTICLE 13 MISCELLANEOUS 13.1 Protection of Mortgagees, No violation, breach, or failure to comply with any provision of this Declaration (hereinafter "violation "), nor any action to enforce any provision of this Declaration, shall affect, defeat, render invalid, or impair the lien of any mortgage taken in good faith for value and perfected by Recording, prior to the Recording of an instrument giving notice of such violation. Further, no such violation shall affect, defeat, render invalid, or impair the title or interest of any purchaser upon foreclosure of any such mortgage or delivery of a deed in lieu thereof. Any such purchaser upon foreclosure shall take title subject to this Declaration; however, violations of this Declaration that occurred prior to the vesting of fee simple title in such purchaser shall not be deemed violations with respect to such purchaser or his heirs, personal representatives, successors, or assigns. 13.2 Compliance with Laws. In addition to the covenants, conditions, and restrictions contained in this Declaration, all Owners shall comply with all applicable laws, statutes, ordinances, rules, and regulations of the City of Grand Island and all other applicable governmental authorities (collectively, the "Laws ").
