<br />This instrument, made this 13th day of November, 2013, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called
<br />"Grantor ", pursuant to a power of sale contained in that certain Deed of Trust recorded on
<br />January 8, 2010 as Instrument No. 0201000185 in the office of the Register of Deeds of Hall
<br />County, Nebraska, and Nice Homes, Inc., hereinafter called "Grantee ".
<br />WHEREAS, on June 26, 2013, Grantor, executed a Notice of Default pursuant to
<br />which notice was given to Robert W. Galliart and Sharon J. Galliart, husband and wife,
<br />Trustors, under that certain Deed of Trust recorded on January / $,""2010 as Instrument No.
<br />0201000185 in the office of the Register of Deeds of Hall County, Nebraska, covering that
<br />certain premises described as:
<br />LOT SEVEN (7), IN BLOCK THREE (3), WOODBINE ADDITION TO
<br />THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and
<br />setting forth the nature of such breach and of his election to sell or cause to be sold such
<br />property to satisfy the obligation. Said Notice,of Default was filed for record in the Office of
<br />the Register of Deeds of Hall County, Nebraska, on June 27, 2013, as Instrument No.
<br />201305120.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76 -1008.
<br />Subsequent thereto, beginning on October 2, 2013, Grantor caused to be published in
<br />The Grand Island Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and
<br />stating that the described property would be sold at public auction to the highest bidder for
<br />cash or certified or cashier's check, at the lower level lobby of the Hall County Courthouse,
<br />1st & Locust Street, Grand Island, Hall County, Nebraska at 10 :00 AM on November 13,
<br />2013. Publication of such notice was made for five consecutive weeks on October 2, 2013,
<br />October 9, 2013, October 16, 2013, October 23, 2013 and October 30, 2013, the last
<br />publication being at least ten (10) days but not more than thirty (30) days prior to the date of
<br />sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat.
<br />§76 -1008.
<br />Pursuant to said Notice of Trustee's Sale, John McDermott attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at
<br />public auction, and did sell the same to Grantee for the sum of $81,000.00, it being the highest
<br />bidder therefor.
