Lindquist, a member of <br /> the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a <br /> power of sale contained in that certain Deed of Trust recorded on August 6, 2009 as Instrument No. <br /> 0200906515 in the office of the Register of Deeds of Hall County,Nebraska, and the Secretary of the <br /> Department of Housing and Urban Development,hereinafter called"Grantee". <br /> WHEREAS, on July 13, 2012, Grantor, executed a Notice of Default pursuant to <br /> which notice was given to Amber Utley and Zachary Utley, wife and husband, Trustors, <br /> under that certain Deed of Trust recorded on August 6, 2009 as Instrument No. 0200906515 <br /> in the office of the Register of Deeds of Hall County, Nebraska, covering that certain <br /> premises described as: <br /> Lot 5 in Bernhard Voss First Subdivision,being a part of Lot numbered One (1) <br /> of Voss Subdivision,being all that part of the East Half of the Southwest Quarter <br /> and the West Half of the Southeast Quarter of Section 11, in Township 11 North, <br /> Range 9 West of the 6th P.M.,Hall County,Nebraska, <br /> that a breach of an obligation for which the trust property was conveyed had occurred,and setting forth <br /> the nature of such breach and of his election to sell or cause to be sold such property to satisfy the <br /> obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of Hall <br /> County,Nebraska,on July 16,2012,as Instrument No. 201205799. <br /> A copy of such Notice of Default was thereafter mailed to all parties entitled to notice <br /> pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008. <br /> Subsequent thereto,beginning on January 21, 2013, Grantor caused to be published in <br /> the Grand Island Independent, a newspaper having a general circulation in Hall County, <br /> Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and <br /> stating that the described property would be sold at public auction to the highest bidder for <br /> cash or certified or cashier's check, at the lower level lobby of the Hall County Courthouse, <br /> 1st & Locust Street, Grand Island, Hall County, Nebraska at 10:00 AM on March 5, 2013. <br /> Publication of such notice was made for five consecutive weeks on January 21, 2013,January <br /> 28, 2013, February 4, 2013, February 11, 2013 and February 18, 2013, the last publication <br /> being at least ten(10)days but not more than thirty(30)days prior to the date of sale. <br /> A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled <br /> to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008. <br /> Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Grantor, did <br /> at the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at <br /> public auction, and did sell the same to Mutual of Omaha Bank for the sum of$94,350.11, it <br /> being the highest bidder therefor. Mutual of Omaha Bank has assigned all of its right, title <br /> and interest in such bid to Grantee. <br /> NOW, THEREFORE, in consideration of the premises and of the sum of$94,350.11 <br /> so bid and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its <br /> successors and assigns forever, all the estate, right, title and interest of which the said Amber <br />
