Contractor does not waive or release any future lien rights that may arise out of work performed for Customer after the date of this Release and Waiver, or out of work performed beyond the scope of the Agreement or pursuant to a different agreement between Contractor and Customer. Contractor hereby represents and warrants that Contractor has not, and will not, assign any claims for work performed pursuant to the Agreement to any third party. Contractor further represents and warrants that all subcontractors or other service providers engaged by Contractor to perform work on Customer's property pursuant to the Agreement have been paid in full, and that there are no claims or liens outstanding against Customer or Customer's property by such subcontractors or other service providers for work performed pursuant to the Agreement. Contractor hereby indemnifies and holds harmless Customer from and against all liability and costs (including reasonable attorneys' fees) arising from any claim or lien that may be asserted at any time in the future against Customer, its heirs, successors or assigns, by Contractor or any other party by virtue of the work performed pursuant to the Agreement.
