#Pine Street - Deed of Trust <br />201308873 <br />20. Beneficiary in Possession. Upon acceleration under paragraph 18 or <br />abandonment of the Property, Beneficiary (in person, by agent or by judicially appointed <br />receiver) shall be entitled to enter upon, take possession of and manage the Property and to <br />collect the rents of the Property including those past due. Any rents collected by Beneficiary or a <br />receiver shall be applied first to payment of the costs of management of the Property and <br />collection of rents, including, but not limited to, receiver's fees, premiums on receiver's bonds <br />and reasonable attorneys' fees, and then to the sums secured by this Deed of Trust. <br />21. Reconveyance. Upon payment of all sums secured by this Deed of Trust, <br />Beneficiary shall request Trustee to reconvey the Property and shall surrender this Deed of Trust <br />and the Note evidencing the debt secured by this Deed of Trust to Trustee. Trustee shall <br />reconvey the Property without warranty and without charge to the person or persons legally <br />entitled to it. Such person or persons shall pay any recordation costs. <br />22. Substitute Trustee. Beneficiary, at its option, may from time to time remove <br />Trustee and appoint a successor trustee to any Trustee appointed hereunder by an instrument <br />recorded in the county in which this Deed of Trust is recorded. Without conveyance of the <br />Property, the successor trustee shall succeed to all the title, power and duties conferred upon <br />Trustee herein and by applicable law. <br />23. Request for Notices. Trustor requests that copies of the notices of default and sale <br />be sent to Trustor's address which is the Property Address. <br />24. Environmental Disclaimer. Trustor warrants (and this shall be a continuing <br />warranty which shall survive until all obligations of Trustor to Trustee and Beneficiary have <br />been fully satisfied) that it is in compliance with all federal, state and local environmental laws <br />and regulations and has obtained all environmental permits necessary or appropriate to the <br />conduct of its business. There is not pending, nor to the best of Trustor's knowledge, after due <br />inquiry, are there any threatened environmental enforcement actions, suits or proceedings before <br />any court, tribunal or administrative body or official. Trustor has not stored, used or disposed of <br />any toxic or hazardous substance on the Property or transported any such substance to or from <br />the Property in violation of any presently existing or previously existing laws, regulations or <br />policies. The Trustor will not store, use or dispose of any substances on the Property.
